Trump Administration Takes Steps to Refund $166 Billion in Tariffs April 20: ...The Trump administration on Monday took its first steps toward returning more than $166 billion collected from tariffs that were struck down in February. Just over a year after imposing many of the duties, the government began accepting requests for refunds, surrendering its prized source of revenue — plus interest. Cox’s Supreme Court Win Damaging—Not Fatal—to Copyright Owners April 20: The U.S. Supreme Court's decision in the Cox Communications Inc. case restricted the scope of platform liability for contributory copyright infringement, but did not immunize ISPs, e-commerce sites, or social media platforms that ignore piracy. The ruling increases the burden on rightsholders to enforce their copyrights, and may push them toward untested legal strategies or to lobby Congress for legislation expanding contributory liability. New! Heat stress guidance: Last week, AAFA released the AAFA Guide to Protecting Workers from Heat Stress. The guidance is intended to provide practical and actionable recommendations that can be operationalized in supply chains to implement policies and procedures to both mitigate and prevent excessive heat days and to protect workers when excessive heat days do occur. Protecting workers in the apparel, footwear, and travel goods industry from extreme heat is becoming increasingly important as global temperatures and the incidence of heat stress in the workplace continue to rise. This publication builds on AAFA’s long-standing efforts to support fair labor practices for garment workers worldwide and specifically its work since 2024 to develop protections against heat stress in the supply chain and is open to all industry stakeholders for widespread sharing of best practices. It will be updated annually. For more on how to use this new open-industry resource, AAFA will host a briefing for all industry stakeholders on May 19 at 10:00 AM ET.

Tariff refunds and supply chain updates: This week, members are eagerly focusing on utilizing U.S. Customs and Border Protection (CBP)’s first phase of the Consolidated Administration and Processing of Entries (CAPE) tool in the Automated Commercial Environment Secure Data Portal (ACE Portal). AAFA is getting mostly positive feedback from members so far; however, more tips and anecdotes will be shared in Beth’s upcoming Trade and Custom Committee (TCC) notes and the next tariff call for members at noon ET on Monday, April 27. Last week, AAFA was incredibly busy on the trade front. In addition to the event in Baltimore, the team: - Submitted comments to the Office of the U.S. Trade Representative (USTR) opposing the U.S. government's Section 301 tariff investigation on excess capacity, targeting 16 countries.
- Submitted comments to the International Trade Commission (ITC) regarding its investigation, Effects on the U.S. Economy of Revoking China’s Permanent Normal Trade Relations Status.
- Delivered comments by the Joint Association Forced Labor Working Group on the U.S. government's Section 301 tariff investigation on forced labor.

Brand Protection updates: Coming up, AAFA has several engagements planned at the International AntiCounterfeiting Coalition Annual Conference (IACC) 2026 from April 28 to 30 in Orlando, FL. At the conference, AAFA will lead meetings with platforms including Walmart, Meta, Shopee, Alibaba, Mercado Libre, and TikTok/TikTok SHOP as well as host a member dinner on Monday, April 27.
