Headquarters JOCELYN SAMUELS SWORN IN AS EEOC COMMISSIONER FOR IMMEDIATE RELEASE Sept. 1, 2016 WASHINGTON – Jocelyn Samuels was sworn in today as Commissioner of the U.S. Equal Employment Opportunity Commission (EEOC), the agency announced this morning.  Samuels was nominated by President Trump on March 16, 2020, and was confirmed on September 23, 2020, to serve as Commissioner, for a term expiring July 1, 2021. Samuels joins Chair Janet Dhillon, Vice Chair Keith Sonderling and Commissioner Charlotte Burrows on the presidentially appointed bipartisan Commission.  "I am delighted to welcome Jocelyn Samuels to the EEOC," said Chair Janet Dhillon.  "Her broad experience in government and in Congress will make her a valued partner as we move to remedy and prevent discrimination in our nation’s workplaces.” From June 2017 until the present, Jocelyn Samuels was Executive Director of the Williams Institute at the UCLA School of Law.  Prior to that, Samuels was the Director of the Office for Civil Rights at the U.S. Department of Health & Human Services and served as Acting Assistant Attorney General for Civil Rights at the U.S. Department of Justice during the Obama Administration.  Earlier in her career, she worked as a senior policy attorney at the U.S. Equal Employment Opportunity Commission, as Labor Counsel to Senator Ted Kennedy, and as the Vice President for Education & Employment at the National Women’s Law Center in Washington, D.C. The then ACP Group of States – which later became the Organisation of the ACP States (OACPS) – and the EU adopted their negotiating mandates in May and June 2018 respectively, thus starting negotiations for a 'post-Cotonou' agreement in September 2018. The main challenge for the EU is to maintain its cooperation with the three OACPS sub-regions and to continue to promote the values enshrined in the EU Treaties. At the same time, the new partnership should take into account the United Nations' sustainable development goals, the redefinition of European strategies in the concerned regions, the new ambitions of the ACP states and the changing balance of power at the global level. Both the EU and the OACPS have agreed on the principle of a common foundation complemented by three regional protocols. These multi-level negotiations and the ongoing discussions on the next EU multiannual budget prevented the new agreement from being finalised by February 2020, the initial expiry date set in the Cotonou Agreement. Thus, in order to avoid a legal vacuum in relations, the provisions of the latter have been extended until the end of 2020. Negotiations are now in their final stages, however some complex issues remain to be solved, among which the institutional setting of the partnership, including the future of the ACP-EU Joint Parliamentary Assembly. L’interdiction de la discrimination est protégée de manière développée et adéquate, essentiellement sur la base de l’article 14 de la CEDH et de la jurisprudence pertinente de la Cour, même si la Convention ne consacre pas explicitement et formellement le principe d’égalité devant la loi. L’effectivité de l’interdiction dépend toutefois du respect de ce droit par les États membres. La lutte contre la discrimination est également promue par des instruments de droit souple. This will require a socio-economic transformation in regions relying on fossil fuels and high-emission industries. As part of the European Green Deal, on 14 January 2020, the European Commission adopted a proposal for a regulation to create the Just Transition Fund, aimed at supporting EU regions most affected by the transition to a low carbon economy. In the context of recovery from the coronavirus pandemic, an amended proposal on the Just Transition Fund (JTF) was published on 28 May 2020, increasingly the previously proposed JTF budget from €7.5 to €40 billion (in 2018 prices, with €10 billion under the core EU budget and €30 billion from Next Generation EU). The European Council cut the core budget part to €7.5 billion and Next Generation EU part to €10 billion in July 2020, while the European Parliament proposed an increase of the core budget resources to over €25 billion in September 2020. Funding will be available to all Member States, while focusing on regions with the biggest transition challenges. The proposed budget for the Just Transition Fund is to be complemented with resources from cohesion policy funds and national co financing. The Fund will be part of a Just Transition Mechanism, which also includes resources under InvestEU and a public-sector loan facility. The Commission expects total funding mobilised under the mechanism to reach at least €150 billion. In the European Parliament, the file has been entrusted to the Committee on Regional Development (REGI). The REGI committee voted on its report on 6 July, and the Parliament subsequently adopted its amendments on 17 September 2020, fixing its position for trilogue negotiations. Third edition. The transition to clean energy will be a challenge for those regions highly dependent on fossil fuels and high-emission industries, in particular regions with a high level of employment in the coal sector. The new Just Transition Fund, complementing the existing cohesion policy funds, will provide support to address the social, economic and environmental impacts of the transition in the most affected territories. This paper looks at the new fund and its allocation mechanism; it focuses on the EU coal industry and the potential for clean energy solutions in a selection of coal regions; and finally, it gives an overview of the level of greenhouse gas emissions in the EU by NUTS2 region. Nach einer Erklärung der einschlägigen Rechtsvorschriften und Rechtsprechung werden der Inhalt, die Grenzen und die mögliche Entwicklung dieser Grundsätze analysiert. Die vorliegende Studie hat den Fall Österreich zum Gegenstand. Die Grundsätze der Gleichheit und der Nichtdiskriminierung sind in Österreich umfassend gewährleistet. Auf verfassungsgesetzlicher Ebene binden der allgemeine Gleichheitssatz und die zu diesem ergehende verfassungsgerichtliche Rechtsprechung das gesamte staatliche Handeln an diese Grundsätze. Der VfGH hat dabei eine Dogmatik entwickelt, die insbesondere eine rechtlich ungleiche Behandlung aufgrund von in der Person gelegenen Merkmalen nur in äußerst engen Grenzen zulässt. Demgegenüber ist das Konzept der „positiven bzw umgekehrten Diskriminierung“ nur wenig ausgeprägt und beschränkt sich im Wesentlichen auf die Herstellung faktischer Gleichheit von Frauen und Männern. Private werden durch die Grundsätze der Gleichheit und der Nichtdiskriminierung lediglich sektoral gebunden, wobei im Wesentlichen unionsrechtliche Vorgaben innerstaatlich umgesetzt werden. Composed of representatives of various European economic and social groups and categories, such as employers, workers, producers, farmers, liberal professions and civil society organisations, the EESC assists the European Parliament, the Council and the Commission in the policy-making and legislative process, in an advisory capacity. EESC members are appointed by the Council according to the proposals of national governments and after consulting the European Commission, for a mandate of five years. Since the 2002 Treaty of Nice the maximum number of EESC members has been fixed at 350. With the withdrawal of the United Kingdom from the EU, the 24 UK members of the EESC also left. In the new mandate starting on 21 September 2020, the total number of members is 329. Over time, the EU Treaties have increased the number of policy areas in which the consultation of the EESC is required for the adoption of legislation; however, the EU institutions often request the Committee's opinion beyond these mandatory areas, and even before legislation is proposed, in order to assess the views of civil society on a specific topic. Importantly, the EESC has acquired the right to give its views on any EU-related issue and the Committee's own-initiative opinions and information reports currently account for around 15 to 20 % of the opinions it adopts every year. In addition to the consultative role assigned by the Treaties, the Committee has set for itself the task of communicating the European Union to citizens, reinforcing participatory democracy and providing a forum for civil dialogue between the EU institutions and civil society. For over 20 years, the EESC has organised events on various topics, cooperated with national economic and social committees and, in general, strived to enhance the role of civil society both in Europe and outside. In all its aspects, the EESC has become a bridge between Europe and organised civil society.
