Briefing - The African Union's first climate strategy – And EU-Africa climate cooperation - 07-11-2022

African countries, which disproportionately suffer from the adverse impacts of climate change, are aiming to strongly voice their position at the 27th Conference of the Parties (COP27, 6-18 November 2022) to the UN Framework Convention on Climate Change (UNFCCC), which is hosted by one of them, Egypt. African states and the African Union (AU) insist that richer industrial countries, which bear greater responsibility for greenhouse gas emissions, should do more to tackle them. According to the African parties to the UNFCCC, Africa's special circumstances should be taken into account when it comes to phasing down the exploitation of fossil fuels. At the same time, the AU is aware that following the same path as richer industrial countries is unsustainable. It has recently made public a comprehensive strategy to address climate change. While non-binding for AU members, this strategy aims to develop resource-efficient industry and make key sectors such as agriculture and food systems, water resources, energy, infrastructure and transport more climate-resilient. This would imply stronger governance of national and regional climate-related programmes, improving climate literacy and setting up efficient early-warning systems and climate information services. It also highlights the need to build on local and indigenous knowledge, and to create safety nets so that no one is left behind in the green transition. With this blueprint, the AU proposes a vision it hopes will rally both its member states and other UNFCCC parties. While the European Union (EU) is among the main supporters of African climate policies, the AU calls upon the EU and international donors to scale up climate finance to help Africa achieve the ambitions laid down in its climate strategy. The European Parliament requests that the EU and its Member States align their policies with the EU's international commitments on climate action, to improve cooperation with Africa in this matter.

On 22 September 2022, the UK government tabled the Retained EU Law (Revocation and Reform) Bill, also referred to as the Brexit Freedoms Bill. It aims to abolish the principle of the supremacy of EU law in the UK by the end of 2023, and proposes to give the government new powers to amend, replace or repeal the EU laws copied into UK domestic legislation following the UK's withdrawal from the EU – 'Brexit'. The bill will now undergo parliamentary scrutiny and votes in both the House of Commons and the House of Lords.

The Schengen area, which is free of systematic controls at internal borders, comprises 22 EU Member States and four non-EU associated countries. While four other Member States – Bulgaria, Croatia, Cyprus and Romania – are bound by the Schengen body of EU law (acquis), internal border controls have not yet been lifted for them. Following a positive Schengen evaluation of Croatia, the Council has prepared a draft decision on the full application of the Schengen acquis in Croatia, and requested the European Parliament's opinion. Parliament is expected to vote on the draft Council decision during the November I part-session.

Cyber-attacks and cybercrime continue to rise worldwide. The EU is planning to increase its cyber-resilience by updating the Network and Information Security (NIS) Directive. The expansion of the scope to be covered by the proposed NIS2 directive, obliging more entities and sectors to take consistent measures, would help increase the level of cybersecurity in Europe in the longer term. The European Parliament is due to vote in plenary in November on the agreement reached in interinstitutional negotiations.

The Single Rulebook – encompassing all EU legislation governing financial institutions – barely touches on operational risks relating to information and communications technologies (ICT). In September 2020, the Commission tabled a proposal for a regulation on the digital operational resilience of the financial sector (DORA), to introduce and harmonise key digital operational requirements across the EU, so as to make ICT operations resilient in the face of severe operational disruption and cyber-attacks.

In April 2021, the European Commission proposed a directive on corporate sustainability reporting. The directive would establish new rules on sustainability reporting in the European Union, based on amending and enlarging the scope of reporting and increasing standardisation under the current Non-financial Reporting Directive. A provisional political agreement reached between the Parliament and Council is scheduled for a vote at first reading during the November I plenary session.

The European Parliament's Committees on Budgets (BUDG) and Economic and Monetary Affairs (ECON) support the use of the Recovery and Resilience Facility (RRF) as the main funding tool of the European Commission's REPowerEU plan. During its November I plenary session, Parliament is due to debate and vote on the BUDG and ECON committees' joint report, which includes various changes to the Commission proposal to amend the RRF Regulation. Once endorsed, the report would become Parliament's mandate for interinstitutional negotiations.

On 24 September 2020, the Commission submitted a proposal for a directive amending a number of existing directives governing the regulation and supervision of the financial system, with a view to tackling risks related to information and communications technologies (ICT).
