Briefing - Replacement benchmarks for financial benchmarks in cessation - 30-11-2020

The pricing of many financial instruments and contracts depends on the accuracy and integrity of (financial) benchmarks, i.e. indices, by reference to which the amounts payable under such financial instruments or contracts, or the value of certain financial instruments, are determined. The anticipated discontinuation of such a benchmark (LIBOR) after the end of 2021 has created fears that it could lead to disruption in the internal market, given that the Benchmarks Regulation ((EU) 2016/1011) does not provide for mechanisms to organise the orderly discontinuation of systemically important benchmarks in the EU. That is why the Commission has proposed to amend the said regulation. The Council adopted its negotiating mandate on 6 October, while the European Parliament's Economic and Monetary Affairs Committee (ECON) adopted its report on 19 November 2020, and also voted to open trilogue negotiations with the Council.

The EU institutions engage in regular structured dialogue with representatives of churches, and religious, non-confessional and philosophical organisations, on the basis of Article 17 of the Treaty on the Functioning of the European Union (TFEU). This dialogue takes the form of high-level meetings or working-level discussions, is focused on policy issues on the European agenda, and traces its origins to earlier initiatives, such as that launched in 1994 by Jacques Delors – 'A soul for Europe' – which aimed to find ways to build an ethical, moral and spiritual dimension into European integration and policy shaping. The draft Constitutional Treaty of 2004 included provisions on regular, open and transparent dialogue between EU institutions, and representatives of churches and religious communities, and of non-confessional or philosophical communities. Although the Constitutional Treaty was rejected in referendums in France and the Netherlands, its successor, the Lisbon Treaty adopted in 2007 and in force since December 2009, preserved the same provisions in Article 17 TFEU. The European Parliament has stressed the importance of constant dialogue among, and with, religious and non-confessional and philosophical communities. Following the entry into force of the Lisbon Treaty, it sought to give substance to the provisions of Article 17 TFEU, primarily through organising dialogue on subjects of interest for the EU and its citizens. This is a further updated version of a briefing last issued in November 2018.

Joseph Biden, who takes office as the next US President on 20 January 2021 has started to announce nominations for key posts in his Administration. Most commentators outside the US, as well as many at home, hope that a Biden presidency will seek to restore a rules-based international order, which has been badly shaken by his predecessor, Donald Trump. Although pundits warn against expecting miracles from the new President in international policy, as the national agenda is likely to be his top priority initially – notably the fight against the coronavirus pandemic, efforts to restore economic growth and the need to try to heal deep divisions in American society – there are still high hopes that Biden will bring the US back into the international community’s pursuit of peace and security, development goals and fighting climate change. This note offers links to recent commentaries, studies and reports from major international think tanks on issues related to US elections and President Biden’s expected policies in a number of areas.

The impact assessment (IA) defines clearly the problem and its underlying drivers. The IA considers a wide range of options, and those retained for further assessment appear to be reasonable and/or justified. However, the IA would have benefited from providing greater clarity on those components that were either included in (short-term exposure limit values) or excluded (biological limit values) from the preferred options. The analysis of impacts focuses on their economic and social dimension, mainly linked to health. Environmental impacts are found to be limited or small but positive, but the analysis could have been substantiated more thoroughly. A cost-benefit analysis of the transitional occupational exposure limit values included in the preferred options was not performed. Stakeholders' opinions have been satisfactorily reported. Finally, the IA appears to have addressed most of the RSB's recommendations and the legislative proposal seems to be consistent with the analysis carried out in the IA.

According to a 2019 report by the United Nations Food and Agricultural Organization (FAO), we know surprisingly little about how much food is lost or wasted, where along the food supply chain this happens, and why. Producing food that is not eaten – whether because it is lost in the field or wasted on a plate – not only diminishes the quantity of food available, but is also a waste of economic and environmental resources, FAO states. Around 88 million tonnes of food waste are generated annually in the EU alone, with associated costs estimated at €143 billion. To address this issue, an EU Platform on Food Losses and Food Waste was established in 2016. The forum brings together key players seeking to provide help to all those involved in: defining measures to prevent food waste, including at EU level; sharing best practices; and evaluating progress made over time. The European Parliament has consistently backed the reduction of food waste. In its resolution of January 2020 on the European Green Deal, the EP calls for an enforceable EU-wide food waste reduction target of 50 % by 2030, based on a common methodology for measuring food waste. Member States are expected to have started collecting data on food waste in 2020 and to report on national food waste levels by mid-2022. As part of the European Green Deal action plan, the European Commission presented in May 2020 a 'Farm to Fork strategy' aimed at making food systems more sustainable. One of the targets included in the strategy is 'stepping up the fight against food waste', that is, cutting food waste by half with the help of legally binding EU-wide targets by 2023. In this context, the Commission also aims to revise EU rules on date marking in order to take account of consumer research indicating that the meaning of date marking on food products is often misinterpreted or misunderstood.

This year, the prize is to be awarded to the democratic opposition in Belarus, represented by the Coordination Council. It rewards its courageous and peaceful role in opposing the falsification of the August 2020 elections, despite a brutal crackdown by the authorities. The Sakharov Prize will be presented in a ceremony during the European Parliament's December plenary session.

Following the 10 November 2020 political agreement between the European Parliament and the Council on the Multiannual Financial Framework (MFF) for 2021 to 2027, the Commission adopted an amending letter (AL 1/2020) to adjust its draft EU budget for the year 2021, presented in July 2020. Moreover, AL 1/2020 also includes updated estimates for agricultural expenditure, other adjustments and technical updates. Overall, AL 1/2020 decreases commitment appropriations by €2 608.8 million and increases payment appropriations by €2 609.3 million on the July 2020 draft budget. The AL 1/2020 changes are incorporated in the draft 2021 budget, which is currently being discussed between Parliament and Council negotiators in the ongoing budgetary conciliation.

In May 2018, the Council authorised the Commission to negotiate a free trade agreement (FTA) with Australia. Negotiations were officially launched in June 2018. Between July 2018 and September 2020, eight negotiation rounds took place. The first chapter of the prospective EU-Australia FTA, concluded at the technical level, is on small and medium-sized enterprises. The ninth negotiation round started on 30 November 2020.

The Commission proposed to set the 55 % greenhouse gas emissions reduction target (compared to 1990 levels) by 2030. The supporting impact assessment is in line with the requirements of the Better Regulation Guidelines when it comes to the combined use of qualitative and quantitative methods and tools, as well as taking on board the Regulatory Scrutiny Board's recommendations. However, the discussion of the socio-economic or environmental implications of the problem identified, the formulation of objectives, the range of scenarios and their comparison based on the mandatory criteria of efficiency, effectiveness, coherence and proportionality and the impact on SMEs fall short of the Better Regulation Guidelines.

This note looks at the 2021 recommendation on the economic policies of the euro area proposed by the Commission. It also provides an overview of the follow up of the 2020 recommendations, making use of public information and based on proxies such as on how the Eurogroup has integrated euro area recommendations concerns in their “thematic discussions” and work programmes. In addition, the note provides a review of the euro area recommendations from an institutional perspective and includes broad comparisons to earlier recommendations, to illustrate how policy concerns have evolved over time. This is an update of similar note on the 2020 recommendations and it will be regularly updated.

Este documento se integra en una serie de estudios que, desde una perspectiva de Derecho Comparado, tienen como objeto analizar los principios de igualdad y de no discriminación en diferentes Estados. Tras la explicación de la normativa y la jurisprudencia de aplicación, se examinan el contenido, los límites y la posible evolución de dichos principios. El presente estudio tiene por objeto el caso del Perú. Las páginas describen, en lo relativo al Perú, y con relación al objeto de estudio, una breve reseña sobre la evolución del concepto igualdad (entendida primero únicamente en un sentido formal) y la progresiva incorporación del principio de no discriminación, para luego pasar a, siquiera en grandes rasgos, describir lo hecho por el Tribunal Constitucional peruano al respecto, efectuando una evaluación crítica de lo avanzado hasta hoy, y poniendo especial énfasis en anotar los retos a enfrentar.

This study, commissioned by the European Parliament’s Policy Department for Citizens’ Rights and Constitutional Affairs at the request of the PETI Committee, presents alternatives for cage housing of farm animals and laying hens and sows in particular. Cage-free housing has a positive effect on the behavioural freedom and welfare of animals. No major problems arise with regard to other aspects of sustainability. Research shows that cage-free housing is currently possible or will be in the future. A shift towards cage-free housing systems may be achieved by financial and policy measures in the short term and legislation in the long term.

The coronavirus pandemic is severely impacting the European population and the economy. Consequently the social and economic impact of the crisis is being felt in all EU regions. Although it is still too early to make concrete predictions about the long-term economic impact, the risks of increased disparities and the unravelling of previous years' progress are real. Furthermore; the consequences of the Covid 19 pandemic could well further impede the social, economic and territorial cohesion of the EU, by exacerbating existing divisions between EU regions. The European Commission has put forward a number of proposals to alleviate the impact of the coronavirus pandemic on EU territories. The European Parliament has been generally supportive of the Commission's proposals, triggering urgent procedures to approve them swiftly so that EU citizens could benefit immediately. Actions under various EU funds and policy instruments are now geared towards health-related purposes and the rekindling of the economy. In these critical times, cohesion policy is increasingly drawn upon to provide emergency relief and liquidity support to affected small and medium-sized enterprises (SMEs) and companies. Amendments to the regulation governing the European structural and investment (ESI) funds were approved by Parliament to allow flexible use of the funds in addressing the challenges posed by the crisis. A number of additional regulations and policy instruments meanwhile complement the ESI funds in the fight against the pandemic's negative consequences. Local and regional authorities are at the forefront of the pandemic, as they are often responsible for providing much of the emergency response. They can use the adopted EU measures to reinforce their coronavirus action and to support their economic sectors. This briefing is an update of an earlier edition, published in May 2020.

The election of the 46th President of the United States took place on 3 November 2020 amidst the unprecedented scenario of the coronavirus pandemic. Following several days of vote-counting, the democratic candidate, Joe Biden, secured the electoral votes needed to become the next President of the United States. His inauguration will take place on 20 January 2021. Domestic concerns, most notably the management of the coronavirus crisis and the economy, as well as racial issues, were the most important subjects in determining voter preference. As usual, foreign policy did not rank highly amidst voters' concerns. However, for the European Union, the impact of the election of Joe Biden on US foreign policy will leave a substantial mark on the future course of transatlantic relations and of global cooperation. While foreign policy under the forthcoming Biden Administration is expected to depart from some of the key tenets of President Trump's 'America First' foreign policy, experts also point to a high possibility of continuity in areas such as trade and relations with China. However, on climate change, multilateral cooperation and support for NATO, expectations are high regarding a potential return to deep levels of transatlantic consensus and cooperation. Biden's foreign policy is likely to focus on multilateral cooperation, for example by re-joining the Paris Agreement on climate change and resuming US support for the World Health Organization. The former Vice-President has stated he will likely re-join the Joint Comprehensive Plan of Action (JCPOA, or Iran Nuclear Deal) in time, and pursue an extension of the New Strategic Arms Reduction Treaty (START) with Russia.

The International Day of Persons with Disabilities has been marked every 3 December since 1992 to promote awareness and mobilise support for critical issues relating to the inclusion of persons with disabilities in society and development. According to the United Nations, a billion people in the world, 80 % of them in developing countries, live with disabilities today. Globally, an estimated 46 % of people aged 60 and over are among those with disabilities. Moreover, one in every five women and one in every 10 children are likely to experience disability in their lifetime. In the EU, there are over 70 million people with a disability, roughly equivalent to 17.5 % of the total population. This figure is set to rise rapidly over the next decade, given that the EU population is ageing and that more than a third of those over 75 have a disability. Worryingly, people with disabilities are among the hardest hit by Covid-19.

Disinformation is an endemic and ubiquitous part of politics throughout the Western Balkans, without exception. A mapping of the disinformation and counter-disinformation landscapes in the region in the period from 2018 through 2020 reveals three key disinformation challenges: external challenges to EU credibility; disinformation related to the COVID-19 pandemic; and the impact of disinformation on elections and referenda. While foreign actors feature prominently – chiefly Russia, but also China, Turkey, and other countries in and near the region – the bulk of disinformation in the Western Balkans is produced and disseminated by domestic actors for domestic purposes. Further, disinformation (and information disorder more broadly) is a symptom of social and political disorder, rather than the cause. As a result, the European Union should focus on the role that it can play in bolstering the quality of democracy and governance in the Western Balkans, as the most powerful potential bulwark against disinformation.

Slowbalisation – understood as the slowdown in global integration – is said to have started in the aftermath of the global financial crisis of 2007-2008. The coronavirus pandemic brought about a further dramatic fall in cross-border movement of goods, services, capital and people, to the extent that commentators have proclaimed the beginning of deglobalisation. This paper examines whether the phenomenon described as slowbalisation is myth or reality, by looking at five different pathways of globalisation: international trade, financial openness, increasing inequality, cross-border social movement, and digital exchanges. The key conclusion is that slowbalisation has not been a uniform trend. While international economic globalisation has indeed slowed, the 'digital leap' and continued inequality suggest that globalisation is merely changing form, not disappearing.

Adopted during the 2007 German Presidency of the Council of the EU, the Leipzig Charter on Sustainable European Cities helped establish the concept of integrated urban development at EU level and was influential in the development of EU initiatives such as the Urban Agenda. It has now been updated to link in with this new urban framework and take account of the fresh challenges facing cities, with the New Leipzig Charter adopted at the informal meeting of ministers responsible for urban and territorial development on 30 November 2020.

As the second wave of the coronavirus pandemic appears to be peaking in Europe, governments and citizens are buoyed by the successful human trials of several vaccines which their producers hope to be able to distribute widely over the coming months. There is growing expectation that, as these vaccines start to become available to the general public in coming months, daily life may gradually return to normal, or at least to a ‘new normal’, during the course of 2021. Meanwhile, many regions of the world continue in some form of lockdown to stave off the second wave. The political debate on health policy is currently focussed not only on priorities for distributing the vaccine in the advanced economies, such as those of the EU, but on how to make it available to poorer countries too, as scientists underline that the virus knows no borders. This note offers links to recent commentaries, studies and reports from major international think tanks on pandemic-related issues. Earlier think tank studies on the issue can be found in the ‘What Think Tanks are Thinking’ of 10 November.

This study examines the normative response of the 27 EU Member States during the first phase of the Covid 19 pandemic (March to mid June 2020) and parliamentary oversight over the measures adopted. The study reveals that Member States' normative responses to the pandemic were generally efficient, as very few of them were not preventively equipped with a set of rules enabling the national authorities to adopt the containment measures needed to address the first peak of the health crisis, and because the Member States lacking those normative tools were able to adopt the necessary empowering legislative acts quickly. The study also reveals that all EU national parliaments played some role in the management of the pandemic, either through the supervision of the measures adopted by the executive to contain the spread of the virus or through the exercise of their ordinary legislative and budgetary powers to provide the government with the normative tools needed to address the pandemic.
