PRESS RELEASE Reform of the EU Court of Justice: The CCBE adopts comments on the functioning of the General Court in the wake of the 2015 Reform 10/09/2020

The CCBE contributes to the ongoing debate on the Reform of the judicial framework of the Court of Justice of the European Union by adopting comments on the efficiency of the General Court, the necessity and effectiveness of the increase to 54 Judges, and the further establishment of specialised chambers and/or other structural changes. The Reform process commenced in 2015 following a Regulation of the European Parliament and the Council to double the number of judges at the General Court. The Court of Justice is currently preparing a report on the functioning of the General Court which is expected will be submitted to the European Parliament, the Council and the Commission before the end of 2020. The CCBE underlines the importance of ensuring all litigants in the European Union may enjoy effective access to justice and quality of justice, as well as the handling of cases in a relatively short time. The CCBE acknowledges that it is a complex challenge that involves taking into consideration different aspects of the functioning of the Court, such as the method of selection of EU Judges by Member States, the intensity of the review exercised by the General Court over decisions of EU Institutions, the quality of hearings, and active case management as used to good effect in certain Member State courts. The CCBE therefore advocates a thorough and independent review by representatives of all stakeholders of how the Union Courts can deliver impartial, high quality justice in the coming years. CCBE President Ranko Pelicarić commented that “The necessary shortening of the average duration of judicial proceedings before the General Court should be achieved without limiting access to justice, reducing the intensity of review of administrative decisions, or taking an increasingly formalistic approach in the application of procedural rules. The CCBE hopes its comments will assist the Court in its efforts to ensure effective access to justice.”

COMMUNIQUÉ DE PRESSE Réforme de la Cour de justice de l'UE : Le CCBE adopte des commentaires sur le fonctionnement du Tribunal dans le cadre de la réforme de 2015 10/09/2020

Le CCBE contribue au débat en cours sur la réforme du cadre judiciaire de la Cour de justice de l'Union européenne en adoptant des commentaires sur l'efficacité du Tribunal, la nécessité et l'efficacité de l'augmentation à 54 juges et la poursuite de la création de chambres spécialisées ou d'autres modifications structurelles. Le processus de réforme a débuté en 2015 à la suite d'un règlement du Parlement européen et du Conseil visant à doubler le nombre de juges auprès du Tribunal. La Cour de justice prépare actuellement un rapport sur le fonctionnement du Tribunal, qui devrait être soumis au Parlement européen, au Conseil et à la Commission avant la fin de l’année 2020. Le CCBE souligne l'importance de garantir à tous les justiciables de l'Union européenne un accès effectif à la justice, la qualité de la justice, ainsi que le traitement des affaires dans un délai relativement court. Le CCBE reconnaît qu'il s'agit d'un défi complexe qui implique la prise en considération de différents aspects du fonctionnement de la Cour, tels que la méthode de sélection des juges de l'UE par les États membres, l'intensité du contrôle exercé par le Tribunal sur les décisions des institutions de l'UE, la qualité des audiences et la gestion active des affaires telle qu'elle est utilisée à bon escient dans certaines juridictions des États membres. Le CCBE préconise donc un examen approfondi et indépendant, de la part de représentants de toutes les parties prenantes, de la manière dont les tribunaux de l'Union peuvent rendre une justice impartiale et de qualité dans les années à venir. Le président du CCBE, Ranko Pelicarić, a indiqué : « La réduction nécessaire de la durée moyenne des procédures judiciaires devant le Tribunal doit être réalisée sans pour autant limiter l'accès à la justice ni réduire l'intensité du contrôle des décisions administratives, ni adopter une approche de plus en plus formaliste dans l'application des règles de procédure. Le CCBE espère que ses commentaires aideront la Cour dans ses efforts pour assurer un accès effectif à la justice. »
