● Council of the EU   22/11/2021 10:22 | MEETING | General Affairs Council, 23 November 2021   Background brief - General Affairs Council, 23/11/2021 Council of the EU General Affairs Council, 23 November 2021 Main results European Council on 16-17 December 2021 Ministers held a first exchange of views on the European Council on 16-17 December, when leaders will come back to the coordination of the response to the COVID-19 pandemic and take stock of work done in the Council on enhancing our collective preparedness, response capability and resilience to future crises. The European Council will also look again at the developments in energy prices as agreed in October. Following the informal dinner in Brdo and the Foreign Affairs Council meeting, leaders will provide guidance on the draft Strategic Compass and EU-NATO cooperation. They will prepare the EU-AU Summit in line with the Leaders' Agenda. The migration situation as well as developments at the border with Belarus will be kept under close review and leaders will come back to this at European Council level as necessary. We started working on shoring up the EU's preparedness for crises on day one of our presidency. At their informal meeting in Brdo pri Kranju on 23 July, the ministers of European Affairs held a discussion on strengthening the Union’s resilience and supported the efforts of the Slovenian presidency towards a more comprehensive response to crises. The presidency concluded that it would prepare conclusions for the General Affairs Council in the light of the ministers’ debate. An ad hoc Working Party was created to specifically prepare draft Council conclusions. The presidency underlined the importance of furthering the enlargement and stabilisation and association process. Ministers reflected on how best to take enlargement forward. The Council reached an agreement last semester on applying the enhanced enlargement methodology to Montenegro and to Serbia, making it possible to hold the first "political" intergovernmental conferences with both countries in June. Also in September the Council gave the final green light to almost 14.2 billion euro of pre-accession financial assistance for the period 2021–2027 in favour of the Western Balkans partners and Turkey. This was the third round of country-specific discussions after the ones in November 2020 and April 2021. Rule of law is a corner stone and the guarantor of our rights and freedoms. This discussion allowed us to face challenges before they become an issue. We maintained our commitment to make the rule-of-law dialogue stronger and more structured, while fully respecting the principles of objectivity, non-discrimination and equal treatment of all member states. Then, each of the five delegations presented key developments and the particular aspects of its national rule of law framework. This was followed by a round of comments in which other delegations shared their experiences and best practices in relation to the developments mentioned. 2021 Rule of law report (European Commission) EU-UK relations European affairs ministers held a discussion on EU-UK relations. They focused in particular on the ongoing talks with the UK regarding practical solutions within the Protocol on Ireland/Northern Ireland to address the difficulties that people in Northern Ireland have been experiencing. European Commission Vice President Maroš Šefčovič updated ministers on the latest developments, including his meeting with David Frost on 19 November, and ministers reiterated their support to the European Commission's approach. The EU highlights the need to shift into a result-oriented mode and to deliver on the issues raised by Northern Irish stakeholders. It is essential that the recent change in tone now leads to joint tangible solutions in the framework of the Protocol. The presidency also stressed that the unity among member states remains a cornerstone of the EU relations and negotiations with the UK. This input will contribute to the development of the joint declaration on legislative priorities for 2022 that will be agreed by the three institutions later this year. In 2016, the Council, the European Parliament, and the Commission agreed to reinforce the Union's annual and multiannual programming through the Interinstitutional Agreement on Better Law-Making. According to this agreement, the Commission should engage in a dialogue with the Council and the Parliament, both before and after the adoption of its annual work programme. Strategic foresight report (European Commission) Letter of intent with regard to the preparation of the Commission Work Programme 2022 EU budget 2022 The Council adopted the 2022 EU budget following an agreement reached with the European Parliament on 16 November 2021. Next year’s budget sets total commitments at €169,5 billion and payments at €170,6 billion. Next year’s budget strongly reflects the EU’s main priorities: economic recovery, fighting climate change, and the green and digital transitions. It also leaves enough resources under the expenditure ceilings of the 2021-2027 multiannual financial framework to allow the EU to react to unforeseeable needs. ● Council of the EU   23/11/2021 19:07 | Press release | The Council adopted conclusions on resilience and crisis response   The Council adopted conclusions on enhancing preparedness, response capability and resilience to future crises. The conclusions, prepared by the Slovenian presidency, set out a series of measures designed to improve resilience, preparedness and response. They stress that the creation of the Integrated Political Crisis Response (IPCR) arrangements in 2013, under the oversight of Coreper, was already an important step towards supporting comprehensive situational awareness and decision-making at EU level, but the response to crises nonetheless needs to evolve, drawing on lessons from the migration crisis and the COVID-19 pandemic. In the future, the EU must be ready to face difference crises of a different nature, which will require improved cross-sectoral and cross-border crisis management. Alongside this, enhanced strategic and crisis communication and fighting disinformation are crucial to support response to crises and build public confidence. The COVID-19 pandemic highlighted the need to work together to strengthen the resilience of the single market to disruptions, including to key EU supply chains and economic sectors, such as pharmaceuticals, medical devices and semiconductors, also taking into account the situation of cross-border communities and vital transit regions. Given the indispensable role of the single market for the EU, the Council emphasises that crisis-related measures should be temporary, proportionate and fully coordinated, with the objective of resuming as soon as possible the normal functioning of the single market, including the free movement of persons, goods, services and capital as foreseen in the Treaties. In June, the European Council requested work be taken forward on enhancing EU’s collective preparedness, response capability and resilience to future crises and to protect the functioning of the internal market. The Ministers of European Affairs, at their informal meeting in July 2021 in Brdo subsequently supported the efforts of the presidency towards a more comprehensive response to crises and now the General Affairs Council has approved these conclusions. Ministers approved conclusions on resilience and crisis response. This agreement forms the Council’s negotiating mandate for trilogue negotiations with the European Parliament. Council of the EU   Press release   24 November 2021   15:25 Digital finance package: Council reaches agreement on MiCA and DORA The Council today adopted its position on two proposals that are part of the digital finance package: the ‘Regulation on Markets in Crypto Assets' (MiCA) and the ‘Digital Operational Resilience Act' (DORA). This agreement forms the Council’s negotiating mandate for trilogue negotiations with the European Parliament. Digital finance is an increasingly important part of Europe’s economic landscape. It is essential to create a stimulating environment for innovative businesses while mitigating the risks for investors and consumers. I think today’s agreement strikes the right balance between the latter. Both files are a priority for the Presidency and we now hope for a quick agreement with the European Parliament on these proposals.Andrej Šircelj, Minister for Finance of Slovenia The purpose of MiCA is to create a regulatory framework for the crypto-assets market that supports innovation and draws on the potential of crypto-assets in a way that preserves financial stability and protects investors. DORA aims to create a regulatory framework on digital operational resilience whereby all firms ensure they can withstand all types of ICT-related disruptions and threats, in order to prevent and mitigate cyber threats. Background and next steps The Commission came forward with the digital finance package on 24 September 2020. The package contains a digital finance strategy, proposals on markets in crypto-assets (MiCA), digital operational resilience (DORA) and a proposal on distributed leverage technology (DLT). This package bridges a gap in existing EU legislation by ensuring that the current legal framework does not pose obstacles to the use of new digital financial instruments and, at the same time, ensures that such new technologies and products fall within the scope of financial regulation and operational risk management arrangements of firms active in the EU. Thus, the package aims to support innovation and the uptake of new financial technologies while providing for an appropriate level of consumer and investor protection. The Council and European Parliament will now enter trilogue negotiations on the proposals. Once a provisional political agreement is found between their negotiators, both institutions will formally adopt the regulations.
