Council adopts €18 billion assistance to Ukraine

 

The Council reached agreement on a legislative package which will enable the EU to help Ukraine financially throughout 2023 with €18 billion. The proposal was adopted by the Council today via a written procedure and it will be submitted to the European Parliament for its possible adoption next week.

"Ukraine can count on the EU. We will continue to support Ukraine, also financially, for as long as it takes. The legislation which we adopted today means that Ukraine can count on regular financial help from the EU throughout 2023."

The package provides for a structural solution to financially support Ukraine in 2023. The amount to be lent to Ukraine in 2023 will be €18 billion, and the loans will have a 10-year grace period. Member states will cover the bulk of the interest costs via external assigned revenues. The guarantees for that borrowing will be provided either by the EU budget or by member states.

The aim is to provide short-term financial relief, financing Ukraine’s immediate needs, rehabilitation of critical infrastructure and initial support towards sustainable post-war reconstruction, with a view to supporting Ukraine on its path towards European integration.

A part of the legislative package, an amendment to the financial regulation, had already been adopted by the Council in Ecofin formation on 6 December.

Background

Russia’s unprovoked and unjustified war of aggression against Ukraine since 24 February 2022 has caused Ukraine a loss of market access and a drastic drop in public revenues, while public expenditure to address the humanitarian situation and to maintain the continuity of state services has increased markedly.

Among other support instruments, between 2014 and 2022 the EU supported Ukraine through several consecutive macro-financial assistance (MFA) operations that exceeded €7 billion of loans and grants.

The EU-Ukraine Association Agreement, which entered into force on 1 September 2017, brings Ukraine and the EU closer together. In addition to promoting deeper political ties, stronger economic links and the respect for common values, the agreement has provided a framework for pursuing an ambitious reform agenda, focused on the fight against corruption, an independent judicial system, the rule of law, and a better business climate. The EU has shown continuous support for these reforms, which are crucial for attracting investments, boosting productivity and lifting the standards of living in the medium term.

Council and Parliament strike provisional deal to create a sustainable life cycle for batteries

 

The Council and the European Parliament today reached a provisional political agreement on a proposal to strengthen sustainability rules for batteries and waste batteries. For the first time the legislation will regulate the entire life cycle of a battery – from production to reuse and recycling – and ensure that they are safe, sustainable and competitive. The deal is provisional pending formal adoption in both institutions.

"Batteries are a key element of the EU's shift towards zero-emission modes of transport. As demand for batteries will grow by more than ten-fold by 2030 we need to make sure we have enough batteries and that they are sustainable throughout their supply chains. The new rules will promote the competitiveness of European industry and ensure that end-of-life batteries will be properly collected and recycled so that useful materials are recovered and toxic substances are not released into the environment."

The provisional agreement reached between the Council and the Parliament will apply to all batteries including all waste portable batteries, electric vehicle batteries, industrial batteries, starting, lightning and ignition (SLI) batteries (used mostly for vehicles and machinery) and batteries for light means of transport (e.g. electric bikes, e-mopeds, e-scooters).

Circular economy

The new rules aim to promote a circular economy by regulating batteries throughout their life cycle. The regulation therefore establishes end-of-life requirements, including collection targets and obligations, targets for the recovery of materials and extended producer responsibility.

The agreement sets targets for producers to collect waste portable batteries (63% by the end of 2027 and 73% by the end of 2030), and introduces a dedicated collection objective for waste batteries for light means of transport (51% by the end of 2028 and 61% by the end of 2031).

The co-legislators agreed to set the target for lithium recovery from waste batteries to 50% by 2027 and 80% in 2031, which can be amended through delegated acts depending on market and technological developments and the availability of lithium.

The agreement provides for mandatory minimum levels of recycled content for industrial, SLI batteries and EV batteries. These are initially set at 16% for cobalt, 85% for lead, 6% for lithium and 6% for nickel. The regulation sets an obligation for batteries to hold a recycled content documentation.

The agreement sets a recycling efficiency target for nickel-cadmium batteries of 80% by 2025 and other waste batteries of 50% by 2025.

The agreement provides that portable batteries incorporated into appliances should be removable and replaceable by the end-user, leaving sufficient time for operators to adapt the design of their products to this requirement (42 months after entry into force of the regulation). This is an important provision for consumers. Light means of transport batteries will be replaceable by an independent professional.

Fair rules for all operators

The new rules aim to improve the functioning of the internal market for batteries and ensure fairer competition thanks to the safety, sustainability and labelling requirements.

This will be reached through performance, durability and safety criteria, tight restrictions for hazardous substances like mercury, cadmium and lead and mandatory information on the carbon footprint of batteries.

The regulation also introduces labelling and information requirements, among other things on the battery's components and recycled content, and an electronic “battery passport” and a QR code.

The agreement also aims to make the text clearer and more coherent and facilitate its application by member states and economic actors on the market with a realistic implementation schedule. Notably, labelling requirements will apply after 36 months after entry into force of the Regulation and after 42 months for the QR code.

Reducing environmental and social impacts

The new regulation aims to reduce environmental and social impacts throughout the life cycle of the battery. To that end, the provisional agreement sets tight due diligence rules for operators who must verify the source of raw materials used for batteries placed on the market. The deal provides for an exemption for SMEs from the due diligence rules.

Main results - Justice and Home Affairs Council, 8-9 December 2022

 

The Council adopted negotiating mandates on environmental crime and digitalisation of justice. It also adopted conclusions on the fight against impunity in Ukraine. Ministers discussed the draft texts on asset recovery and confiscation and on strategic lawsuits against public participation. Over lunch they discussed the fight against antisemitism.

Fight against impunity in Ukraine

The Council adopted conclusions on the fight against impunity regarding crimes committed in connection with Russia’s war of aggression against Ukraine.



Nine months into the war, Russia continues its horrific and indiscriminate attacks against Ukrainian citizens and civilian infrastructure. Every day new discoveries are made of war crimes committed in Ukraine. The EU stands by Ukraine and its people and will continue supporting Ukrainian authorities and the ICC to ensure those responsible for these crimes are brought to justice.Pavel Blažek, Czech Minister of Justice

The conclusions call on member states and the relevant EU bodies to continue supporting the Ukrainian Prosecutor General’s Office and the International Criminal Court (ICC). It also asks member states to adopt measures to fully implement the definition of core international crimes and modes of liability and to allow the exercise of universal jurisdiction or other forms of domestic jurisdiction over these crimes. Asset recovery and confiscation

Ministers discussed the draft directive on asset recovery and confiscation. They focused in particular on the procedural rights of non-suspects. They considered whether the rights to a fair trial and an effective remedy as included in the proposal provide sufficient protection to all persons affected by the measures. They also assessed whether to extend the right of defence to persons who are not those being charged with the criminal offence but are affected by the measures.

Ministers broadly expressed support for providing procedural protection to all persons affected by the measures, including persons not accused or suspected of a crime, at least to the extent provided for in the proposal. Environmental crime

The Council agreed its mandate for negotiations with the European Parliament on the environmental crime directive. This proposal aims to improve the investigation and prosecution of environmental crime offences. It defines environmental crime more precisely and adds new types of environmental criminal offences. Digitalisation of justice

The Council today adopted its mandate for negotiations with the European Parliament on the proposed regulation on the digitalisation of judicial cooperation and access to justice and proposed accompanying directive. Strategic lawsuits against public participation (SLAPP)

Ministers discussed for the first time the draft directive against strategic lawsuits against public participation (anti-SLAPP directive). They focused in particular on the need for adequate safeguards against the abuse of civil proceedings while ensuring that the right to effective access to justice is maintained.

This proposal seeks to protect journalists and human rights defenders against abusive litigation aimed to silence them. Member states have broadly supported the goal of the directive to protect the right to freedom of expression and information. They have also flagged the need to ensure that the procedural safeguards provided for in the proposal will not be abused and that the claimant's access to justice, which is also a fundamental right, will still be guaranteed. Fight against antisemitism

Over lunch, ministers discussed the fight against antisemitism. They considered how to maximise efforts to fight antisemitism at all levels and across society, how to effectively streamline the discussions, which instruments are most fundamental to fight antisemitism online, what member states are doing to improve recording and reporting of antisemitic incidents and what actions are being taken to secure and allocate adequate financial resources on national and EU levels.
Fundamental rights

Ministers discussed the EU’s accession to the European convention on Human Rights, in particular the final outstanding elements of these negotiations. The negotiations with the Council of Europe were formally relaunched in June 2020 and have since then made very good progress, with provisional agreements reached on a number of key elements.

Under other items the Commission presented its annual report on the application of the EU fundamental rights charter. The focus of this year’s report is on the empowerment of civil society organisations, rights defenders and justice practitioners as key actors in our democracies.
e-evidence

The Presidency reported on progress made on the e-evidence proposals. It informed ministers of the provisional political agreement reached with the European Parliament on 29 November. Technical work is now ongoing to finalise the legal texts so that they can be submitted to member states for endorsement.

Fight against cybercrime

The Council adopted conclusions on enhancing the capacities of the European judicial

Other business

The presidency also reported on the preparations and agenda for the next EU-US ministerial meeting in the area of justice and home affairs, as well as on the outcome of the EU-Western Balkans ministerial forum on Justice and Home Affairs.Joint press statement EU-Western Balkans Ministerial Forum

The Presidency informed ministers on the conference on whistleblowing which took place in Prague on 26-27 October. This meeting took a look at the developments in the transposition of the directive on whistleblowing and on the protection of whistle-blowers more generally.

The Presidency also presented the results of the workshop on digitalisation of justice which took place on 24 October in Brussels.

The Commission presented a recommendation on procedural rights of suspects and accused persons subject to pre-trial detention and on material detention conditions.

The upcoming Swedish presidency of the Council presented its work programme and priorities for the next six months.
Home affairs (Thursday 8 December)
Schengen area

The Council today adopted a decision on the full application of the Schengen acquis in Croatia.



I am very pleased that during the Czech Presidency, Croatia was able to take two important steps in its European integration by joining both the euro and the Schengen areas. Ministers also looked at the overall state of the Schengen area, with a focus on internal security measures including the interoperability of IT systems and countering migrant smuggling. They endorsed a series of actions to fight migrant smuggling, covering three areas: maintaining robust situational awareness, supporting stronger cross-border operational action against criminal networks and the role of JHA agencies and inter-agency cooperation. Ministers also endorsed the revised timeline for the entry into operation of the upgraded Schengen Information System, which is now expected to take place by 7 March 2023.
Asylum and migration

The presidency provided a state of play on asylum and migration files. During the past months, intensive work has mainly focused on finding a way forward on EU migration solidarity, responsibility and crisis response. Work to integrate these principles in the legislative texts will continue under the upcoming Swedish presidency. The presidency also informed about recent positive developments related to the inter-institutional cooperation between the Council and the European Parliament, allowing to restart work on 5 legislative proposals under the Pact on migration and asylum.

Ministers assessed progress in ongoing work on a regulation to address situations of instrumentalisation in the field of migration and asylum. This regulation would allow member states facing a situation of instrumentalisation to exceptionally derogate from some of the common European asylum rules, where necessary and proportionate. Ministers also exchanged views on the external dimension of migration and the situation along the main migratory routes. They highlighted the need to address the external dimension of migration in a comprehensive manner, taking into account all routes and making joint or complementary efforts where possible. Under this point, the European Commission presented its recent action plan on the Western Balkan route, which follows its action plan on the Central Mediterranean, issued on 21 November. The Commission was invited to propose action plans on the remaining routes.

Over lunch, ministers discussed how to improve the effectiveness of the EU return policy. They underlined the importance of the visa leverage and endorsed a timeline proposed by the presidency while underlining the need to use leverage in different fields to improve the third country cooperation on readmission.

Russia’s aggression against Ukraine

Ministers exchanged views on the situation of Ukrainian refugees in the EU, in particular as
regards accommodation and reception facilities, and on contingency planning during winter. According to the latest figures, EU member states are hosting nearly 4 million Ukrainian refugees and at least 700 000 children are enrolled in the education systems.

Ministers also took stock of the internal security dialogue with Ukraine to address shared
security challenges stemming from Russia’s war of aggression, including border security or the risk
of illicit firearms trafficking and other serious crime.

Under other business the Commission updated ministers on the response provided in the context of the EU civil protection mechanism to challenges arising from the war in Ukraine, including on recent challenges in the field of energy.

The Council also adopted without discussion a decision not to accept Russian documents issued in Ukraine and Georgia. Resilience of critical infrastructure

The Council adopted a directive and a recommendation which aim to reduce the vulnerabilities and strengthen the resilience of critical entities. These entities provide essential services that are crucial for the maintenance of vital societal functions, economic activities, public health and safety, and the environment. Child sexual abuse

Ministers assessed progress made on the draft regulation to prevent and combat child sexual abuse online. Discussions in the Council have taken place at technical level, which has concluded the first examination of the full text. Following this, the Presidency has presented several proposals to revise the text, notably covering the subject matter and scope, definitions, obligations of online service providers and supervision, enforcement and cooperation. Ministers were briefed on the cooperation between competent authorities dealing with counter-terrorism, in the presence of the counter-terrorism group (CTG).

The Presidency informed on the outcome of the Prague process ministerial conference, where a joint declaration and an action plan for 2023-2027 were adopted.

Portugal presented a point on the designation of the Director General of the International Organisation for Migration (IOM).

The Commission presented a point on wildfire preparedness in the context of the EU civil protection mechanism, following the intense fire season this summer in the EU.

The upcoming Swedish presidency of the Council presented its work programme and priorities for the next six months.

The Council of Ministers of Justice adopted the Conclusions on combating impunity for crimes committed in the context of Russia’s war of aggression against Ukraine:

“Russia’s war of aggression against Ukraine has been going on for more than nine months. War crimes committed in Ukraine are being exposed on a daily basis. As the situation drags on, we should do everything we can to help Ukraine and its authorities. In this context, the authorities of various Member States have provided forensic assistance to support the investigation of war crimes by the Ukrainian authorities and the Prosecutor of the International Criminal Court. I have called on my colleagues to continue to provide such assistance. Preferably through the International Criminal Court, which is doing an excellent job in coordinating this assistance,” Minister of Justice Pavel Blažek said.

The Council of Ministers also approved the Conclusions on strengthening the capacity of the European Judicial Network to fight cybercrime. Their aim is to strengthen this judicial network, in particular by establishing a permanent secretariat to enable the network to meet the needs and expectations of professionals working in the field of cybercrime.
Electronic evidence

At today’s meeting, the Czech Presidency informed the other ministers that an overall preliminary agreement had been reached with the European Parliament on the entire legislative package on electronic evidence. "I am very pleased that we have succeeded in negotiating this preliminary agreement. At the same time, I am convinced that we have finally succeeded in laying the foundations for a modern system for the transmission of electronic evidence. We will have an open path to agreements in this field with our partners, for example with the USA," Pavel Blažek said.

The Council today also approved three general approaches. These general approaches mean that the Council has agreed on a position that will form the basis for negotiations with the European Parliament, which will be led by the incoming Swedish Presidency.
Environmental protection through criminal law

"Today, thanks to this Council meeting, we have taken another step towards obtaining a legal instrument to protect the environment. We need effective sanctions against individuals and organisations that profit from activities that threaten our health and damage our ecosystems. Protecting the environment is one of the major challenges of our generation. Both in Europe and globally," Pavel Blažek said.
Regulation and Directive on the digitalisation of judicial cooperation

These two rules are primarily aimed at achieving faster, cheaper, safer and more reliable communication between competent authorities and between competent authorities and natural and legal persons. This will also increase legal certainty, improve citizen access to justice and make court proceedings more efficient. In cross-border proceedings within the EU, persons and their legal representatives will be able to communicate electronically with the competent authorities through a European electronic access point set up on the European e-Justice portal.

The ministers also discussed some aspects of the proposal for a Directive on asset recovery and confiscation, stressing the need to ensure adequate procedural safeguards for persons who are not themselves being prosecuted but who are affected by some of the measures under the Directive.

In the case of the proposal for a Directive on protecting persons who engage in public participation (SLAPP), ministers debated the need to balance the requirement to ensure freedom of speech by sanctioning strategic lawsuits while ensuring access to justice for legitimate lawsuits.

On the occasion of the last formal meeting of the Justice and Home Affairs Council under the Czech Presidency, Minister of Justice Pavel Blažek thanked all his colleagues for the tremendous efforts they had made in coordinating many areas of joint work during this half-year. This was followed by the symbolic handover of the Presidency, or rather the judicial gavel, to Sweden.

"It has been an honour and a pleasure to chair the Council during our Presidency. Sweden will now take up the baton and I hope that the Swedish Presidency will be a great success. I would like to thank all my colleagues for their support over these six months. I think we have done a very good job, but it would definitely not have been possible without their help and support. We have presided over Europe at a very difficult time. We have faced an unprecedented confluence of many negative security and prosperity phenomena. I can say with a clear conscience that we have met these challenges with honour," Pavel Blažek concluded.

Main results
A new approach to cancer screening

The Council adopted a new recommendation on cancer screening to bring down the mortality of cancer and cut the incidence of invasive cancers. Cancer is a major disease and cause of death throughout Europe. In 2020, an estimated 2.7 million people in the EU were diagnosed with cancer.

The new recommendation contains updated methodologies and tests for breast, cervical and colorectal cancer screening and introduces organised cancer screening programmes for lung, prostate and, in certain circumstances, gastric cancer.

Screening makes it possible to detect cancers at an early stage, or possibly even before they become invasive. Thanks to early testing, some lesions can then be treated more effectively, with a greater chance that patients can be cured.

Vaccination: COVID-19 vaccine procurement and European cooperation

Ministers exchanged views on COVID-19 vaccine procurement. At the current stage of the pandemic, a significant number of member states are dealing with an oversupply of vaccines, raising multiple budgetary and logistical questions. Many ministers evoked the success of the joint purchase of COVID-19 vaccines and how the common vaccination strategy saved lives.

Ministers also discussed future steps in view of a possible adaptation of the existing contracts. Several ministers welcomed the Commission's announcement to convene a meeting at political level of the vaccine steering board. It was also pointed out that one should avoid producing vaccines that could only be used over a certain period of time due to a limited shelf life.

The Council also approved Council conclusions on vaccination as one of the most effective tools for preventing disease and improving public health. They highlight that member states could benefit from an even more coordinated EU approach on vaccination to prevent and limit the spread of epidemics and vaccine-preventable diseases. The conclusions focus on two areas of action: combatting vaccine hesitancy and preparing for upcoming challenges through EU cooperation.


Vaccination is an effective means against infectious diseases. Βιογραφικό του Κυριάκου Μητσοτάκη Ο Κυριάκος Μητσοτάκης γεννήθηκε το 1968 στην Αθήνα. Αφού αποφοίτησε αριστούχος από το Κολλέγιο Αθηνών συνέχισε τις σπουδές του στην Αμερική. Σπούδασε κοινωνικές επιστήμες στο Harvard από όπου αποφοίτησε με την ανώτατη τιμητική διάκριση «summa cum laude» ενώ τιμήθηκε με τα έπαθλα «Hoopes» και «Tocqueville» για την εκπόνηση της διατριβής του με θέμα την αμερικανική εξωτερική πολιτική απέναντι στην Ελλάδα. Συνέχισε τις σπουδές του στο Stanford, στον τομέα των διεθνών οικονομικών σχέσεων και τις ολοκλήρωσε στο Harvard Business School στον τομέα της διοίκησης επιχειρήσεων. Πριν ασχοληθεί με την πολιτική, εργάστηκε επί μία δεκαετία στον ιδιωτικό τομέα στην Ελλάδα και το εξωτερικό. Διετέλεσε οικονομικός αναλυτής στην Chase Investment Bank και σύμβουλος στην κορυφαία εταιρία συμβούλων McKinsey and Company στο Λονδίνο. Μετά την επιστροφή του στην Ελλάδα, εργάστηκε ως ανώτατο στέλεχος επενδύσεων στην Alpha Ventures της Alpha Bank και στη συνέχεια μετακινήθηκε στον Όμιλο της Εθνικής Τράπεζας της Ελλάδας. Διατέλεσε για τρία χρόνια Διευθύνων Σύμβουλος της Εθνικής Επιχειρηματικών Συμμετοχών, την οποία και ανέδειξε σε κορυφαία εταιρεία στην Ελληνική και Βαλκανική αγορά του private equity και του venture capital. Η Εθνική Επιχειρηματικών Συμμετοχών χρηματοδότησε πολλές γρήγορα αναπτυσσόμενες επιχειρήσεις με ίδια κεφάλαια, δημιουργώντας εκατοντάδες θέσεις απασχόλησης. Για την επαγγελματική του δραστηριότητα έχει λάβει τιμητικές διακρίσεις, με σημαντικότερη την βράβευσή του το 2003 από το World Economic Forum ως “Global Leader for Tomorrow”. Στις εκλογές του 2004 και του 2007 εξελέγη πρώτος σε σταυρούς προτίμησης βουλευτής με τη Νέα Δημοκρατία στη μεγαλύτερη εκλογική περιφέρεια της χώρας, τη Β΄ Αθηνών, ενώ στις εκλογές του 2009 εξελέγη για τρίτη φορά. Στις εκλογές του Μαΐου 2012 εξελέγη για μία ακόμη φορά πρώτος στη Β’ Αθηνών, ενώ ήταν επικεφαλής του ψηφοδελτίου στις εκλογές του Ιουνίου 2012. Στη Βουλή των Ελλήνων έχει συμμετάσχει στην Επιτροπή Αναθεώρησης του Συντάγματος και στις Επιτροπές Οικονομικών, Παραγωγής και Εμπορίου, Ευρωπαϊκών Υποθέσεων και Εξωτερικών και Άμυνας ενώ διετέλεσε για δύο χρόνια Πρόεδρος της Επιτροπής Περιβάλλοντος. Έως τις εκλογές του 2012 ήταν Τομεάρχης Περιβαλλοντικής Πολιτικής της Νέας Δημοκρατίας. Έχει επισκεφθεί πολλές περιβαλλοντικά ευαίσθητες περιοχές της χώρας, έχει συμμετάσχει σε δεκάδες συνέδρια για το περιβάλλον στην Ελλάδα και το εξωτερικό μεταξύ αυτών στις διεθνείς διασκέψεις του ΟΗΕ για την κλιματική αλλαγή στο Μπαλί, το Πόζναν, το Κανκούν και την Κοπεγχάγη. Διετέλεσε Υπουργός Διοικητικής Μεταρρύθμισης και Ηλεκτρονικής Διακυβέρνησης από τις 25 Ιουνίου 2013 μέχρι τις 27 Ιανουαρίου 2015. Στις εθνικές εκλογές της 25ης Ιανουαρίου 2015 εξελέγη για πέμπτη φορά βουλευτής της ΝΔ στη Β’ Αθηνών τετραπλασιάζοντας τους σταυρούς που έλαβε σε σχέση με τις εθνικές εκλογές του Μαΐου 2012. Στις 10 Ιανουαρίου 2016 εξελέγη πρόεδρος της Νέας Δημοκρατίας και αρχηγός της Αξιωματικής Αντιπολίτευσης. Στις 7 Ιουλίου 2019 εξελέγη Πρωθυπουργός της Ελλάδας. Μιλάει Αγγλικά, Γαλλικά και Γερμανικά και έχει εκδώσει το βιβλίο «Οι Συμπληγάδες της Εξωτερικής Πολιτικής». Έχει τρία παιδιά, τη Σοφία, τον Κωνσταντίνο και τη Δάφνη.
