Briefing - Support for fishermen affected by the eastern Baltic cod closure - 22-02-2021

Eastern Baltic cod has long supported the livelihoods of many Baltic fishermen, but stocks of this valuable fish have been declining sharply in recent years. Every year since 2014, total allowable catches have been reduced accordingly. Scientific advice published in May 2019 reinforced the concerns regarding eastern Baltic cod, and estimated the stock to be below safe biological limits. Scientists point to high natural mortality resulting from various environmental pressures, including a lack of salinity, little oxygen, pollution, high water temperatures and parasite infestation. In July 2019, as an emergency measure, the Commission imposed an immediate closure of the fishery, with the exception of a limited amount arising from by-catch. Subsequently, fishing opportunities for 2020 and 2021 were limited to by-catches. As recovery of the stock is not expected before 2024, the Commission issued a proposal in order to allow support for permanent cessation. After two trilogue meetings, the Council and Parliament reached provisional agreement on the proposal on 22 September 2020. The agreement extended the scope of the support to include fishermen targeting cod and herring in the western Baltic, due to the poor state of, and reduced fishing opportunities for, those stocks. The agreed text was adopted by the EP on 11 November 2020 and by the Council on 13 November 2020. It was published in the Official Journal on 30 November 2020. Third edition. The InvestEU programme is a single investment support mechanism for the 2021-2027 period. It will bring together various EU financial instruments for internal policies previously supported by different funds and programmes of the EU budget. On 7 December 2020, Parliament and Council negotiators reached political agreement on InvestEU. The EU guarantee, set at €26.2 billion, is expected to mobilise at least €372 billion of investment across the EU (in current prices). In addition, at Parliament’s insistence, EIB legacy portfolios will be consolidated with InvestEU, which could mobilise an extra €35-40 billion in investment. Under the national compartment, Member States will be able to allocate amounts to InvestEU from funds under shared management and from the new Recovery and Resilience Facility. Composed of four policy windows (sustainable infrastructure; research, innovation and digitalisation; SMEs; and social investment and skills), InvestEU is designed to contribute to the green transition in various ways, including through investment targets and a horizontal Just Transition Scheme. Parliament is due to vote on the compromise text during its March I 2021 plenary part-session. Second edition. As a party to the Paris Agreement, the European Union has committed to implementing climate mitigation policies to keep the average temperature rise to well below 2°C, while pursuing efforts to limit it to 1.5°C. Meeting the more ambitious goal of 1.5°C requires bringing the level of global net greenhouse gas emissions to zero by around 2050, according to the Intergovernmental Panel on Climate Change (IPCC). Following this scientific consensus, the European Commission presented in 2019 the European Green Deal as the strategy towards a climate-neutral Europe by 2050, and proposed a European climate law in 2020 to make this target legally binding. The IPCC scenarios consistent with limiting the temperature rise to 1.5°C show that removing CO2 from the atmosphere is essential and complements the implementation of emissions reduction policies. In line with this, the European science academies recommend prioritising deep emissions cuts, but also to start developing a portfolio of carbon dioxide removal (CDR) options immediately. Various options are being discussed in light of the growing consensus that meeting the established targets is dependent on CDR. These range from nature-based practices – such as forestation, soil carbon sequestration and wetland restoration – to technological alternatives such as enhanced weathering, bioenergy with carbon capture and storage, and direct air capture and storage. Nature-based solutions stand out as more cost-effective and viable in the short run, while some technological alternatives have potential to become more relevant later this century. The European Commission recognises the crucial role of CDR, and intends to focus on nature-based options. An extensive revision of the EU climate mitigation legislation, planned for 2021, will provide an opportunity to set a regulatory framework for CDR. The European Parliament has repeatedly called for prioritising emissions reductions over CDR, and stressed the importance of conserving biodiversity and enhancing natural sinks and reservoirs. Its position on the proposed European climate law involves removing GHGs that exceed manmade emissions in the EU and each Member State from 2051.

Given the important role they play in the rollout of zero-emission mobility and the storage of intermittent renewable energy, batteries are a crucial element in the EU's transition to a climate neutral economy. Global battery demand is expected to increase 14-fold by 2030, making this market an increasingly strategic one. The proposal presented by the European Commission is designed to modernise the EU's regulatory framework for batteries in order to secure the sustainability and competitiveness of battery value chains. It would introduce mandatory requirements on sustainability (such as carbon footprint rules, minimum recycled content, performance and durability criteria), safety and labelling for the marketing and putting into service of batteries, and requirements for end-of-life management. The proposal also includes due diligence obligations for economic operators as regards the sourcing of raw materials. The legislative process is in its early stages. In the Council, the proposal is being examined by the Working Party on the Environment. In Parliament, the file has been referred to the Committee on Internal Market and Consumer Protection, which appointed Antonius Manders as rapporteur.

This briefing finds that the European Commission's impact assessment (IA), which accompanies the directive proposal on the resilience of critical entities, provides a good evidence-based problem definition and a sufficiently broad range of options. The assessment is mostly qualitative, due to difficulties in quantification. The IA could have been more transparent in its description of stakeholder views, and could have provided due references and a link to the feasibility study which has supported the IA. Further explanations to support the preferred option in terms of efficiency would have benefited the analysis.

Of all the disputed areas claimed by China, the South China Sea (SCS) has been the most prominent in recent years, since it involves the largest number of actors with overlapping claims to maritime features and waters, as well as non-claimant countries, owing to its strategic importance as one of the world's busiest shipping lanes. In 2020, China stepped up its salami-slicing tactics to assert its sweeping 'historic' rights, while Malaysia, Indonesia, the Philippines, and Vietnam dismissed them in an alignment of positions supported by a 2016 landmark arbitration award under the United Nations Convention on the Law of the Sea (UNCLOS). In 2020, the United States' previous neutral position on China's maritime claims shifted to dismissing them as unlawful. The EU remained attached to its position of not taking sides with either party's claims. Some EU Member States have become more vocal in dismissing China's 'historic' rights and have increased their presence in the SCS. The Taiwanese went to the polls in early 2020 and overwhelmingly elected President Tsai Ing-wen of the Democratic Progressive Party (DPP) for a second term, while navigating pervasive disinformation and influence operations and closely watching events in Hong Kong. The Covid-19 pandemic was an opportunity for Taiwan to leverage its robust virus containment policy for global outreach. The self-ruled democratic island somewhat reduced its economic overreliance on mainland China through diversification and relocation strategies. Taiwan witnessed a spike in military incursions into its airspace and waters by mainland China's air and naval forces. Key issues to watch are the impact of the strategic rivalry between the US and China on Taiwan's economy and the future of US strategic ambiguity as a deterrent against a potential hostile invasion of the island. First, we highlight the economic and political significance of RCEP for the region stressing that it is the culmination of past efforts by East Asian countries to pursue economic integration. Second, we show that the agreement itself is considerably less ambitious than comparable agreements such as the Comprehensive and Progressive Transpacific Partnership (CPTPP) and European Union Free Trade Agreements with Asian countries. Third, we document that the final legal text itself does not seem to be dominated by any specific party. Fourth, despite its lack of ambition, the agreement is still expected to provide substantial trade gains for signatories, especially if it helps to consolidate global supply chains based in the region. Fifth, because of its structure, it is likely to be an important focal point for trade liberalization in the future providing European companies with important opportunities.

d’analyse de la ratification des traités internationaux dans différents États dans une perspective de droit comparé. L’objet de cette étude est d’examiner la ratification des traités internationaux en droit allemand. Le régime juridique applicable et la procédure, sont spécialement étudiés afin d’avancer une estimation des délais nécessaires pour cette ratification. Après une introduction générale, cette étude examine d’abord les dispositions législatives et réglementaires régissant la procédure d’adoption des traités, ensuite la répartition des compétences entre les différents acteurs impliqués, et enfin les principales étapes de la procédure de conclusion des traités. Dans le cas de l’Allemagne, l’enjeu est la répartition des rôles entre le Gouvernement fédéral, le Président fédéral et le Parlement, auquel la Loi fondamentale accorde un droit d’approbation pour certains traités. De plus, l’organisation fédérale allemande doit être prise en compte, dans la mesure les Länder disposent d’une compétence propre en matière de conclusion de traités. Dans nombreux cas, les Länder sont d’ailleurs responsables de leur transposition en droit interne. La présente étude entend donner aux organes du Parlement européen un aperçu complet des processus de ratification des traités par les États et dans le cas présent l’Allemagne). Ainsi le Parlement pourra tenir compte des délais de ratification des traités futurs par ses partenaires, et organiser ses travaux en conséquence. The United Kingdom's decision to leave the European Union has brought significant uncertainty for the fisheries sector. Fisheries, and especially EU fishing rights in UK waters, played a prominent role in the recent negotiations on future EU-UK relations and ultimately became the final obstacle to reaching an agreement, being the very last point to be agreed. The new EU-UK Trade and Cooperation Agreement, settled on 24 December 2020, marks an important milestone in the long history of fisheries relations in the North-east Atlantic. The agreement maintains full access to waters until 30 June 2026, with part of the EU quota shares gradually transferred to the UK during this period. After 1 July 2026, access to waters will be decided by a process of annual consultations. The quota shares will remain stable at the 2025 level, and can only be changed with the mutual consent of both parties. The Trade and Cooperation Agreement ensures that fisheries and aquaculture products continue to be traded without tariffs, but non-tariff measures associated with the UK leaving the EU common market, such as certification requirements and customs controls, will involve slower and more expensive trade flows.

The European Union (EU) is a one-of-a-kind maritime actor, which brings both opportunities and responsibilities. It is argued that if the EU-27 were to combine the capacities and capabilities of their navies, they would form one of the world's largest maritime powers. There is therefore space for better integration of capabilities and for greater coherence among the EU's tools to promote its multi-dimensional strategic maritime interests. As around 90 % of global goods are traded via maritime routes, freedom of navigation, security, sustainability and respect for international law are crucial for the EU. These routes are however becoming increasingly contested and restricted, reflecting new patterns of global power distribution. In the security and defence field, the EU's common security and defence policy instruments, particularly its missions and operations abroad, are the most visible manifestation of its maritime actorness. The maritime dimension of the EU's security and defence policy has been put in the spotlight by Portugal, the holder of the EU Council presidency in the first half of 2021. Two of the 17 EU missions and operations are naval military operations: EUNAVFOR Somalia Atalanta in the western part of the Indian Ocean, and EUNAVFOR MED Irini in the central part of the Mediterranean Sea. EU Member States also participate in multinational maritime coalitions as well as in NATO's own maritime operation, Sea Guardian, patrolling the entire Mediterranean Sea. In following the orientations provided by its maritime and global strategies, the EU is aiming to increase its capacity and reliability as a maritime security actor. One example is its coordinated maritime presences, launched in January 2021 with a pilot case in the Gulf of Guinea to boost the EU's maritime capacity and global outreach. Another is the EU's action to boost its maritime defence capabilities through the various post-2016 initiatives that aim to incentivise collaborative projects. Finally, the EU has also enhanced its cooperation with NATO in ensuring maritime security in the transatlantic space, although political obstacles remain.

On 15 December 2020, the European Commission adopted a proposal to revise the 2013 regulation on trans-European networks in energy (TEN-E). The revised TEN-E Regulation is currently under discussion in the European Parliament and the Council, which will prepare their negotiating positions. The 2013 TEN-E Regulation sets out EU guidelines for cross-border energy infrastructure and outlines the process for selecting projects of common interest (PCI). PCIs are infrastructure projects considered essential for delivering on EU objectives in the energy field, including improved interconnection between national markets, greater competitiveness, security of supply, and promotion of renewable energy sources. The list of PCIs is updated every two years. Some PCI projects are eligible for EU financing from the Connecting Europe Facility (CEF). The revised TEN-E Regulation would align closely with the ambitious climate neutrality objectives of the European Green Deal, primarily by supporting energy infrastructure that consolidates new and existing clean energy technologies, and by ending policy and financial support for fossil fuel projects, which would no longer be included on PCI lists and thus unable to receive CEF funding.

The crisis of democracy and the rise of authoritarianism across the globe, compounded by the coronavirus pandemic, highlight the importance of taking a more strategic and autonomous approach to supporting democracy worldwide – an objective often balanced against other external policy aims until now. Since the start of the current parliamentary term, the EU has reviewed its political guidance on democracy and human rights. It has adopted or is about to adopt important measures to strengthen support for democracy (including better monitoring and enforcement of relevant provisions in trade arrangements). The adoption of the new multiannual financial framework (MFF) and of a new development aid instrument bringing together all former external aid instruments provides new opportunities for better implementing EU funding and better exploiting the EU's leverage as a major provider of development aid. Digital challenges and the narrowing space for civil societies are among the priorities to be addressed. The challenge of engaging more difficult partners, such as China and Russia, has inspired calls to broaden the scope of a values-based agenda to other economic relations, such as investments. These new measures complement an already broad and complex toolbox integrating various external policies. Using the enhanced powers in external affairs provided by the Treaty of Lisbon, the EU has set up extensive political and diplomatic dialogues to enhance partnerships beyond the more asymmetric, specific development assistance and trade leverage going back to the 1990s. While the EU has responded to violations of democratic norms by reducing aid and withdrawing trade preferences, it has consistently sought to build equal partnerships based on constructive and open dialogues, rather than use its economic and commercial traction in a coercive manner. One hundred years after women won the vote or were first elected to parliament in some EU countries, the data show that women continue to be under-represented in politics and public life, in the European Parliament, national parliaments and governments, and local assemblies. The arguments for gender balance in politics are numerous, and benefit not only women and female politicians, but also parties themselves and the rest of society. After all, women form half the population and need to be better represented in power structures. However, there is now solid evidence both of obstacles and of the strategies that are effective when it comes to increasing women's participation and representation. Here, political parties and the media can be both barriers and important enablers. The EU has committed to achieving a gender balance in political representation and participation as a matter of justice, equality and democracy. Concrete recommendations have been made for achieving this goal, including specific action that could be taken by the EU institutions, national governments, political parties, civil society and the media. The ongoing coronavirus pandemic has shone a spotlight on the issue of women's leadership and its implications for gender equality. Regional airports are an important part of the aviation system in the European Union (EU). They are engines of socio-economic development and improve accessibility to certain locations, in particular those that are remote or not well served by other forms of transportation. They also have a vital role in terms of economic and social cohesion, stimulating tourism and employment, as well as facilitating access to essential services. In addition, they can help to reduce congestion at major hub airports. The Covid 19 pandemic has hit regional airports hard, especially those more dependent on passenger traffic, which has been more severely hit than cargo traffic. The situation is so difficult that without government support, many regional airports, which serve local communities, face the risk of insolvency. Meanwhile, the pandemic is putting airports under pressure to become more digital. Moreover, a greater focus on tackling climate change is driving various projects to make airports more sustainable. The recovery from the crisis is likely to take several years. It will depend on several factors, such as the duration and magnitude of the crisis, pace of vaccination and consumer confidence. The speed with which the economy recovers will also affect how long the recovery of air travel will take. All this requires support. The EU has taken steps to ensure that Member States can make full use of the flexibility allowed under State aid rules, to provide regional airports with support to overcome this unprecedented crisis. Since March 2020, the European Commission has approved numerous State aid schemes from which regional airports can benefit. The EU can also support airports through its Recovery and Resilience Facility, which aims at making Europe more sustainable, resilient and better prepared for the challenges and opportunities of the green and digital transitions.

This study proposes an overview of the selection of Special Advisers to the European Commission, specifically during the period 2014-2019: the procedure followed, number of contracts, safeguards, contractual terms, budgetary implications, transparency, communication with the European Parliament. A review of literature, good practices and criteria for assessing the European Commission framework is provided. In conclusion this study makes recommendations on how to further strengthen it.

The EU fruit and vegetable sector is heavily dependent on a non-national labour force, either from other EU Member States or third countries. Germany, Italy, Spain, France and Poland, in particular, employ high numbers of migrant seasonal farm workers. While these numbers have been steadily increasing, they compensate only partly for the ongoing decline in national agricultural workforces. Migrant seasonal workers from the EU are entitled to fully equal treatment with nationals of the host country under the fundamental right to the free movement of workers within the EU, whereas third-country nationals are covered by the Seasonal Workers Directive of 2014, which grants them equal treatment as regards terms of employment and some social benefits. EU Member States manage their own seasonal worker schemes depending on the needs of the domestic labour market, their ties with third countries and their broader immigration system. The reality of seasonal agricultural work is a harsh one, with generally poor working and living conditions. Undocumented migrants, but also legal ones, can fall victim to illegal gang-master practices or even modern forms of slavery. Exploitation of women occurs in certain regions. The coronavirus pandemic, which disrupted harvests in the spring of 2020 as seasonal workers faced travel restrictions, also highlighted their essential role in EU agriculture and laid bare their sometimes appalling working and living conditions. Reacting to this situation, the European Parliament adopted a resolution on the protection of seasonal workers in June 2020, calling on Member States to ensure proper implementation of the relevant EU legislation and on the European Commission to issue new specific guidelines and propose long-term solutions to fight abusive practices and protect victims. In July 2020, the Commission responded to this call by issuing new guidelines on the protection of seasonal workers in the context of the pandemic, announcing further action, including ongoing work with the European Labour Authority.

In the midst of the current pandemic, adopting a gender perspective may seem a secondary concern. However, pandemics are known to affect women and men differently, making it essential to recognise these differences in order to understand the impacts on individuals and communities and to respond effectively and equitably. There is already clear evidence that the ongoing health, social and economic crisis is having gendered impacts. Disaggregated data show that sex and gender are playing a role in exposure to the virus and risks of severe outcomes, and that some groups of women and men are particularly vulnerable. Lockdown measures have led to an increase in violence against women and disrupted access to support services. Access to sexual and reproductive healthcare has also been affected. Successive lockdowns have widened the existing gender divide in unpaid care work that was already keeping more women than men out of the labour market. Greater work-life conflict is one of the factors leading to women's employment being worse hit than men's, with potential long-term impacts on women's employment, pay and career advancement. The pandemic has also brought the issue of women's participation in decision-making to the fore. Without a gender-sensitive approach, the pandemic could have far-reaching implications, including a real risk of exacerbating gender inequalities and sending progress into reverse. At the same time, gender mainstreaming tools such as gender impact assessments and gender budgeting exist that could, if used effectively, mitigate the negative consequences and contribute to achieving gender equality. Internationally and within the European Union (EU), there have been calls for gender-sensitive emergency and long-term responses. In January 2021, the European Parliament adopted a resolution setting out recommendations on both aspects.

For the tenth time since the outbreak of the coronavirus crisis, the European Council met by video-conference, however this time in two separate sessions. The first, on 25 February, dealing with the ongoing coronavirus pandemic and ways of increasing the EU’s health resilience, is covered in this paper, while the second, the following morning, addressed security and defence as well as the southern neighbourhood, and is covered by a separate paper. Regarding the pandemic, EU leaders called for acceleration in the authorisation, production and distribution of vaccines, reiterated their solidarity with third countries, and acknowledged that non-essential travel still needed to be restricted while ensuring the unhindered flow of goods and services within the single market. To strengthen the EU’s resilience to future health emergencies, EU leaders will seek to improve coordination to ensure better prevention, preparedness and response. However, further EU integration in health policy was excluded, with the conclusions stressing that these actions should be carried out ‘in line with the Union competences under the Treaties’. EU leaders also called on the Commission to draw up a report on the lessons learned from this crisis, to take forward the work on the European health union, and underlined the need for a global approach, including an international treaty on pandemics.
