Statistics and research results show that in recent decades, before the coronavirus pandemic, the EU's labour market witnessed an increase in female employment rates. Women's employment seems to have been more resilient than men's to the economic and financial crisis in 2008. This was due in part to long-term developments and changes in the institutional framework, but also to women's tendency to work in particular sectors and accept flexible working arrangements (such as part-time work or teleworking). The coronavirus crisis, however, has had a harsher impact on women than on men when it comes to the labour market. One of the main reasons is that men tend more to work in sectors considered as essential economic activities (with the exception of healthcare), whereas women's work often involves contact with customers and clients, making teleworking impossible. Women have also been faced with increased childcare needs, reducing their ability to work, while enjoying a lower level of social protection owing to their working arrangements. Although EU legislation takes account of the situation of women in the labour market, and a number of legislative and non-legislative initiatives have recently been taken at EU level, a number of challenges remain. Areas where action is required include: the harmonisation of retirement schemes, to take the specific nature of women's careers into account; better reconciliation of work and family life by means of more flexible employment arrangements; and action to address the perennial gender pay gap. This is an update of an earlier briefing on Trends in female employment, from October 2015, PE 569.049.

This briefing forms part of an EPRS series offering syntheses of the pre-legislative state of play and consultation on key European Commission priorities during the current five-year term. It summarises the state of affairs in the relevant policy field, examines how existing policy is working on the ground, and, where possible, identifies best practice and ideas for the future on the part of governmental organisations at all levels of European system of multilevel governance. Based on EPRS analysis, partner organisations at European, national, regional and local levels point to the following main considerations that they consider should shape discussion of the forthcoming initiative on fair minimum wages for workers in the EU: • There are fears regarding the implications of the EU initiative for the respective national systems, with the various stakeholders suggesting a cautious approach as part of what could prove to be a long-term discussion. A complex differentiated approach with several safeguards, adapted to the respective systems in place, would appear to be key to avoiding an initiative with only minimal ambitions. • A broad consensus is observed regarding the need to reinforce the social partners; strengthening social dialogue and promoting collective bargaining should be used as an opportunity to explore ambitious measures in this area. • The unresolved debate on the effects of higher minimum wages on the economy and employment situation underlines the need for detailed and regular analysis, including by means of greater use of impact assessment tools. This would be valuable in order to prevent negative consequences and demonstrate the added value of EU action. • Some specific (complementary) instruments deserve to be considered, such as the country-specific recommendations of the European Semester and public procurement procedures.

Dieses Dokument ist Teil einer Reihe von Studien, mit denen die Grundsätze der Gleich-heit und der Nichtdiskriminierung in verschiedenen Staaten aus rechtsvergleichender Sicht dargestellt werden sollen. Nach einer Erklärung der einschlägigen Rechtsvorschrif-ten und Rechtsprechung werden der Inhalt, die Grenzen und die mögliche Entwicklung dieser Grundsätze analysiert. Die vorliegende Studie hat den Fall Deutschland zum Gegenstand. Die Grundsätze der Gleichheit und Nichtdiskriminierung sind in Deutschland am wirk-mächtigsten in Art. 3 Grundgesetz verankert: als Grundrechte in Form des sog. allgemei-nen Gleichheitssatzes (Absatz 1) und der beiden speziellen Garantien (Absätze 2 und 3). Das Bundesverfassungsgericht hat diese Rechte schrittweise konkretisiert und durchge-setzt; inzwischen gestalten viele Gesetze die Gleichheitssätze in verfassungskonformer Weise aus, so für das Privatrecht das Allgemeine Gleichbehandlungsgesetz.

Based on EPRS analysis, partner organisations at European, national, regional and local levels point to the following main considerations that they consider should shape discussion of the forthcoming European climate pact: * In the area of energy-efficient building, the climate pact would offer added value in better coordinating the roles and responsibilities of different governmental levels, so as to increase the return on investment that would be felt by citizens. This could, for instance, be achieved by focusing investment on the largest energy consumers, such as public hospitals, schools and social housing. * In terms of low-carbon mobility, the climate pact would provide a platform to exchange ideas regarding the appropriate level of taxation for carbon-intensive means of transport, further tax reforms in the EU Member States to remove fossil fuel subsidies, and a shift of the tax burden towards polluters. * When it comes to working together on climate change, the climate pact would facilitate multi-level cooperation to ensure that the shared goals of climate neutrality translate into concrete action at the local and regional levels, which will eventually be responsible for implementing them, by 2050. This would in particular require improved integration of existing consultation strategies and developing new tools, including comparable geographical maps online. The overall input received indicates that the EU level is expected to set the standards in climate policy through 'shared leadership'. At the same time, each level of governance, from small isolated communities to large cities, and from regional governments and national parliaments to EU institutions, has generated concrete ways to contribute in this process, often by providing examples of good practice and lessons learnt, which could be applied and adapted across the EU.

During the second October 2020 plenary session – the first at which Members were able to speak remotely, and not only vote, from the Member States – the European Commission presented its 2021 work programme, which Members largely welcomed. Members also discussed the conclusions of the 15 16 October 2020 European Council meeting, EU measures to mitigate the social and economic impact of Covid 19, police brutality within the EU, the sale of EU passports and visas to criminals, the State of the Energy Union and aligning the Energy Charter Treaty with the European Green Deal. Parliament announced that its 2020 Sakharov Prize will be awarded on 16 December to the Belarusian opposition, in particular the Coordinating Council, for 'an initiative launched by courageous women'.

Scarcity of medical equipment during the COVID-19 crisis, and the ensuing discussion on ‘reshoring’ certain industries back to Europe, have brought back an old dilemma. Namely, countries wish to be strategically independent while depending on products and resources from other countries to fulfil their economic needs. This reflects the debate about whether markets or governments are better at delivering solutions. We can also define this debate as a choice between ‘competitive capitalism’ and ‘strategic autonomy’. Calls for strategic autonomy have increased since the COVID-19 crisis, at national and EU level. However, strategic autonomy conflicts with the achievements of international cooperative governance. This introduces another dilemma: the choice between interests and values. Pursuing interests alone leads to a vicious cycle of increased competition between markets and between states, ultimately deteriorating into imperialism. Developing value-oriented actions at government and market level can break that vicious cycle. Value-oriented concepts already form part of many EU policies, which place substantial emphasis on environmental and social rights. When ethical values become an integral part of business and government decisions, this is called ‘due diligence’. We can define value-oriented international cooperation between governments as ‘cooperative governance’. Similarly, we can define ethical and value oriented action by private actors — whether NGOs or businesses — as ‘ethical capitalism’. Putting the two dichotomies on a grid creates a model of four possible scenarios for action which can aid our understanding of ongoing discussions on governance in a post COVID-19 world. EU policy makers could also use these scenarios as alternative ways of shaping EU and foreign policy. The management of natural resources, ranging from water, land, forests, energy resources and metals to rare earths, shows a counter-clockwise development through the scenarios. Moving away from unregulated markets, extraction and use were gradually regulated by national governments, who competed against each other in an imperialist setting. The transnational nature of economic and environmental problems has increasingly brought them into the scope of international cooperative governance. Ethical capitalism (changing market forces from within) is a relatively new development complementing government action. Progress through the scenarios is not always sequential: actors face pressures to switch between them. We can draw lessons for governance in a post COVID-19 world from the experiences of natural resources management. This study is the first on ´global trends in external policies´, aiming to develop forward-looking and strategic analyses.

The aim of this joint project by the European Added Value and Budget units of DG EPRS is to establish whether and under what circumstances budgetary benefits and cost savings can be realised by Member States through funding policies and programmes with EU added value at EU level instead of at MS level, and measure the scale of such benefits and savings. On the one hand, higher EU added value can be achieved through additional provision of public goods, efficiency gains, and lower administrative costs delivered by the EU budget. In parallel, this can also result in positive spillovers and additional saving for the national budgets. Failure to take advantage of these benefits or of these potential savings can thus lead to a de-facto wasted budgetary resources. The study looks into detail at these issues and provide a comprehensive methodology to arrive at a robust estimation of the level of budgetary waste by Member States

The general objective of TEN-E policy is to link the energy infastructure of EU countries. The current guidlines for the trans-European energy infrastructure were established by Regulation (EU) No 347/2013 (the TEN-E Regulation). The European Commission is currently carring out a multi-step revision process of the regulation, with a view to making the EU energy infrastructure fully consistent with and a driver for the EU's 2050 climate neutrality ambition. In this respect, a new proposal is expected by the end of 2020.

Gender budgeting has a fundamental impact on inclusive and economic growth, fostering employment, reducing poverty, addressing ageing population and increasing Gross Domestic Product (GDP). According to the study of the European Institute for Gender Equality (EIGE), the estimated impact of improved gender equality varies considerably across member states from 4% to 12% of GDP, depending on the present level of achievement of gender equality.

This study, commissioned by the European Parliament's Policy Department for Citizens' Rights and Constitutional Affairs at the request of the LIBE Committee, covers the challenges facing the civil society space. Watchdog NGOs and other human rights defenders have been under pressure during the humanitarian and rule of law ‘crises’. Several EU Member States have passed laws that fall short of international, regional and EU freedom of association standards. Some governments have used the COVID-19 pandemic to further restrict the civic space. The study explores how the EU could protect civil society from unjust state interference by strengthening freedom of association, assembly and expression, as well as the right to defend human rights. The study elaborates on four policy options: introducing a European association statute; establishing internal guidelines to respect and protect human rights defenders; developing a civil society stability index; and creating a network of focal contact points for civil society at EU institutions. It recommends strengthening the independence of critical civil society actors and increasing funding for activities such as strategic litigation to uphold EU laws and values.

After coming to a political agreement on the trade pillar of the three-pronged EU-Mercosur association agreement in June 2019, the EU and the four founding members of Mercosur (Argentina, Brazil, Paraguay and Uruguay) reached agreement on the political dialogue and cooperation parts in July 2020. However, as environmental deregulation and deforestation continue unabated in Brazil, opposition to the deal is growing. It is unlikely to be submitted to the European Parliament for consent in its current form. A study of the trade pillar's provisions concludes that, taking the risk of deforestation into account, the deal's environmental costs are likely to exceed its economic gains. This raises doubts as to whether Brazil's compliance with its climate change commitments can realistically be achieved based on provisions devoid of an effective enforcement mechanism.

The European Commission has proposed to amend Directive 2004/37/EC, by expanding its scope and by including and/or revising occupational exposure limit values for a number of cancer- or mutation-causing chemical agents. The initiative is proceeding in steps and has now become a continuous process. Following on from three previous legislative amendments, which covered a total of 26 priority chemical agents, the present (fourth) proposal addresses an additional three. The proposal was announced as one of the first measures of the Commission's commitment to fight cancer under the forthcoming Europe's Beating Cancer plan. Broad discussions with scientists and social partners fed into all four proposals. The Commission's feedback period on the proposal will run until 20 November 2020. While broadly welcoming the proposal, professional organisations, trade unions and patient groups would like carcinogenic and mutagenic hazardous medicines as well as substances toxic for reproduction to be brought within the scope of the current proposal. The legislative process is in its early stages. In Parliament, the Committee on Employment and Social Affairs is in charge of the file. Offshore wind is a highly promising renewable energy source (RES) that could make a major contribution to global and European efforts to decarbonise the economy by 2050 and keep global warming to around 1.5°C above pre-industrial levels, as set out in the Paris Climate Change Agreement. The European Commission expects the EU to produce at least 240 gigawatts (GW) of global offshore wind power capacity by 2050, while international organisations specialising in the energy field are even more optimistic about the prospects of this energy source. Europe accounts for 80 % of global offshore wind capacity and is the dominant region in terms of technologies and manufacturing. Offshore wind accounts for 210 000 jobs in Europe (over half of all jobs in wind energy), and this number should increase further with greater investment. Wind is the only offshore RES that is currently deployable on a commercial scale and there is vast untapped potential in the world's oceans and seas, even if only some potential sites can be developed. Offshore wind has a higher capacity and more consistent output than other variable RES, with the International Energy Agency describing it as a unique 'variable baseload' technology that could help to integrate the decarbonised energy systems of the future. A major constraint on offshore wind has been the difficulty of building fixed constructions in depths greater than 60 metres. Floating bases for offshore wind turbines could then prove to be a game changing technology, allowing much wider exploitation of wind resources. Many of the leading projects for commercialising these floating technologies are based in Europe. Hybrid projects linking offshore wind to other uses – such as hydrogen production or battery storage – represent another important avenue for offshore wind to contribute more widely to our energy systems. The Commission is expected to adopt a new strategy for offshore RES in 2020, proposing further EU action to scale up deployment of offshore wind and invest in its underlying technologies. Some EU Member States have set their own indicative targets for offshore wind deployment by 2030, accompanied by a range of support schemes. The European Parliament has been supportive of offshore wind energy, in particular the potential for a North Sea offshore grid (energy hub).

In September 2020, the European Commission submitted a proposal on asylum and migration management, to replace the 2013 Dublin Regulation that determines the EU Member State responsible for examining asylum applications. While the proposal 'essentially preserves' the current criteria for determining this responsibility, it would also make changes and additions to the regulation, especially on solidarity and responsibility-sharing for asylum-seekers among Member States. The proposal comes after a failed attempt to reform EU asylum policy following the 2015 migration crisis. While the migratory context has changed since, both in terms of arrivals and the composition of flows, the migration situation remains fragile, as evidenced by pressures on national asylum systems and continual disembarkations after search and rescue operations. According to the Commission, addressing this situation requires a relaunch of the reform of the common European asylum system to achieve a more efficient, fair and harmonised framework that is more resistant to future migratory pressures. The new system would ensure international protection to those who need it and be effective and humane towards those who have to be returned. First edition. EU banks entered the coronavirus crisis with high capital and liquidity buffers resulting from the reforms undertaken after the global financial crisis of 2007-2009. This allowed a bold and swift response by supervisors oriented towards supporting banks’ ability to provide credit to the real economy. This paper provides an overview and an assessment of the regulatory response to the crisis, and suggests some recommendations for the future design of countercyclical regulation.

While multiple causes underpin accounting scandals such as Wirecard, they often point at deficiencies in the audit profession and its oversight. Currently, the system of national public audit oversight boards (POBSAs) is fragmented and overly complex, characterized by limited responsiveness to red flags, and apparent lack of communication among the POBSAs, and with other supervisors. This suggests supervisory coordination and clear action triggers are imperative. Importantly, pervasively low transparency limits the usefulness of this briefing and hinders evidence-based policy making.

The accelerated 'truth decay' and the partisan polarisation of the debate about the handling of the continued surge in Covid 19 cases and deaths will likely further undermine trust in institutions, while accelerated societal anxiety could increase the potential for post-election tension.

After coming to a political agreement on the trade pillar of the three-pronged EU-Mercosur association agreement in June 2019, the EU and the four founding members of Mercosur (Argentina, Brazil, Paraguay and Uruguay) reached agreement on the political dialogue and cooperation parts in July 2020. However, as environmental deregulation and deforestation continue unabated in Brazil, opposition to the deal is growing. It is unlikely to be submitted to the European Parliament for consent in its current form. A study of the trade pillar's provisions concludes that, taking the risk of deforestation into account, the deal's environmental costs are likely to exceed its economic gains. This raises doubts as to whether Brazil's compliance with its climate change commitments can realistically be achieved based on provisions devoid of an effective enforcement mechanism.

The European Commission has proposed to amend Directive 2004/37/EC, by expanding its scope and by including and/or revising occupational exposure limit values for a number of cancer- or mutation-causing chemical agents. The initiative is proceeding in steps and has now become a continuous process. Following on from three previous legislative amendments, which covered a total of 26 priority chemical agents, the present (fourth) proposal addresses an additional three. The proposal was announced as one of the first measures of the Commission's commitment to fight cancer under the forthcoming Europe's Beating Cancer plan. Broad discussions with scientists and social partners fed into all four proposals. The Commission's feedback period on the proposal will run until 20 November 2020. While broadly welcoming the proposal, professional organisations, trade unions and patient groups would like carcinogenic and mutagenic hazardous medicines as well as substances toxic for reproduction to be brought within the scope of the current proposal. The legislative process is in its early stages. In Parliament, the Committee on Employment and Social Affairs is in charge of the file. Offshore wind is a highly promising renewable energy source (RES) that could make a major contribution to global and European efforts to decarbonise the economy by 2050 and keep global warming to around 1.5°C above pre-industrial levels, as set out in the Paris Climate Change Agreement. The European Commission expects the EU to produce at least 240 gigawatts (GW) of global offshore wind power capacity by 2050, while international organisations specialising in the energy field are even more optimistic about the prospects of this energy source. Europe accounts for 80 % of global offshore wind capacity and is the dominant region in terms of technologies and manufacturing. Offshore wind accounts for 210 000 jobs in Europe (over half of all jobs in wind energy), and this number should increase further with greater investment. Wind is the only offshore RES that is currently deployable on a commercial scale and there is vast untapped potential in the world's oceans and seas, even if only some potential sites can be developed. Briefing - Reforming asylum and migration management: A shift towards greater solidarity? - 30-10-2020

In September 2020, the European Commission submitted a proposal on asylum and migration management, to replace the 2013 Dublin Regulation that determines the EU Member State responsible for examining asylum applications. While the proposal 'essentially preserves' the current criteria for determining this responsibility, it would also make changes and additions to the regulation, especially on solidarity and responsibility-sharing for asylum-seekers among Member States. The proposal comes after a failed attempt to reform EU asylum policy following the 2015 migration crisis. While the migratory context has changed since, both in terms of arrivals and the composition of flows, the migration situation remains fragile, as evidenced by pressures on national asylum systems and continual disembarkations after search and rescue operations. According to the Commission, addressing this situation requires a relaunch of the reform of the common European asylum system to achieve a more efficient, fair and harmonised framework that is more resistant to future migratory pressures. The new system would ensure international protection to those who need it and be effective and humane towards those who have to be returned. First edition. EU banks entered the coronavirus crisis with high capital and liquidity buffers resulting from the reforms undertaken after the global financial crisis of 2007-2009. This allowed a bold and swift response by supervisors oriented towards supporting banks’ ability to provide credit to the real economy. This paper provides an overview and an assessment of the regulatory response to the crisis, and suggests some recommendations for the future design of countercyclical regulation.

We analyse the recent policy decisions made by the ECB and the national authorities related to capital, liquidity, and shareholders’ remuneration aimed at promoting credit supply from the banking sector to the coronavirus-afflicted economy. We forecast the impact of the regulatory decisions based on the empirical literature, discuss the factors that reduce the banks’ incentives to expand loan portfolios and develop policy suggestions intended to mitigate the effect of these factors.

While multiple causes underpin accounting scandals such as Wirecard, they often point at deficiencies in the audit profession and its oversight. Currently, the system of national public audit oversight boards (POBSAs) is fragmented and overly complex, characterized by limited responsiveness to red flags, and apparent lack of communication among the POBSAs, and with other supervisors. This suggests supervisory coordination and clear action triggers are imperative. Importantly, pervasively low transparency limits the usefulness of this briefing and hinders evidence-based policy making.

The potential of the ongoing pandemic to accelerate already existing or underlying trends has become particularly visible ahead of the Presidential election in the United States. The coronavirus crisis has boosted environmental factors that can increase radicalisation, while at the same time intensifying the spread of conspiracy theories that can have a similar effect. The accelerated 'truth decay' and the partisan polarisation of the debate about the handling of the continued surge in Covid 19 cases and deaths will likely further undermine trust in institutions, while accelerated societal anxiety could increase the potential for post-election tension.
