Claims for Refund or Credit of Federal Excise Tax on Wine, Beer, Distilled Spirits, and Tobacco Products Lost in a Natural Disaster

Businesses (retailers, wholesalers, importers, exporters, and manufacturers of beverage alcohol and importers, export warehouse proprietors, and manufacturers of tobacco products and processed tobacco) may file claims with TTB for the payment (refund or allowance of credit) of federal excise taxes paid on beverage alcohol or tobacco products lost, rendered unmarketable, or condemned by a duly authorized official under various circumstances, including natural disasters.

Retailers and wholesalers of tobacco products may only file a claim if the loss occurs as the result of a presidentially declared major disaster.To determine whether a Presidential declaration has been made, visit Disaster Declarations at FEMA.gov. Avoiding Common Errors on Your Labels – Government Health Warning Statement

Some of the most common problems we see on alcohol beverage labels are errors in the mandatory health warning statement, including punctuation and formatting. 

 

The following health warning statement must appear on all alcohol beverages sold in the U.S. that contain 0.5% or more alcohol by volume:

 

GOVERNMENT WARNING: (1) According to the Surgeon General, women should not drink alcoholic beverages during pregnancy because of the risk of birth defects. (2) Consumption of alcoholic beverages impairs your ability to drive a car or operate machinery, and may cause health problems.

ACTION: Notice and request for comments

 

SUMMARY: The Office of the United States Trade Representative (USTR) has to submit a report to Congress regarding the operation of the Caribbean Basin Initiative (CBI) on or before December 31, 2025. The Trade Policy Staff Committee (TPSC) invites comments concerning the operation of the CBI, including the performance of each beneficiary country and whether they are meeting the criteria pursuant to the CBI, to assist in preparing the report to Congress on the operation of the CBI program.

 

DATES: The deadline for the submission of written comments is 11:59 p.m. EDT on July 16, 2025.
