TTB Publishes Temporary Regulations to Implement CBMA Import Refund

The Craft Beverage Modernization Act (CBMA) provisions of the Internal Revenue Code (IRC) provide for reduced rates or tax credits for certain quantities of beer, wine, and distilled spirits produced in or imported into the United States. A recent change in the law transferred responsibility for administering the CBMA tax benefits for imported alcohol from U.S. Customs and Border Protection (CBP) to TTB beginning with products entered for consumption in the United States on or after January 1, 2023. 

Accordingly, TTB is publishing a temporary rule implementing these provisions and providing procedures for foreign producers and importers.  We are also publishing a notice of proposed rulemaking to obtain comments on the provisions in the temporary rule and on an additional regulatory provision.  Comments on that notice are due by November 22, 2022.

Comment Period closing for ‘American Single Malt Whisky’ Standard of Identity

On July 29, 2022, we issued Notice No. 213, Proposed Addition of American Single Malt Whisky to the Standards of Identity for Distilled Spirits. In this proposed rule, we propose to amend the regulations in 27 CFR part 5 that set forth the standards of identity for distilled spirits to include “American single malt whisky” as a type of whiskey that is a distinctive product of the United States.

Proposed Establishment of the Yucaipa Valley AVA


We are accepting comments through November 21, 2022, on Notice No. 214, Proposed Establishment of the Yucaipa Valley Viticultural Area, which we published in the Federal Register on Wednesday, September 21, 2022.  The proposed 36,467-acre Yucaipa Valley viticultural area (AVA) is located in San Bernardino County, California, and is not located within any established AVA.

 

We are making this proposal in response to a petition filed on behalf of local grape growers and winemakers.  We designate viticultural areas to allow vintners to better describe the origin of their wines and to allow consumers to better identify wines they may purchase.

 

You may submit comments electronically on this proposal and view copies of the proposed rule, selected supporting materials, and any comments we receive about this proposal at Regulations.gov within Docket No. TTB–2022–0008.  A link to that docket is posted at our Wine – Notices of Proposed Rulemaking page under Notice No. 214.

SUMMARY: The Office of the United States Trade Representative (USTR), through the Trade Policy Staff Committee (TPSC), publishes the National Trade Estimate Report on Foreign Trade Barriers (NTE Report) each year. USTR invites comments to assist it and the TPSC in identifying significant foreign barriers to, or distortions of, U.S. exports of goods and services, U.S. foreign direct investment, and U.S. electronic commerce for inclusion in the NTE Report. USTR also will consider responses to this notice as part of the annual review of the operation and effectiveness of all U.S. trade agreements regarding telecommunications products and services that are in force with respect to the United States.

 

DATES: The deadline for submission of comments is Friday, October 28, 2022, at 11:59 p.m. ET.
